McKinleyville is a big place without a city government. The 2020 Census counted 16,262 people there, more than Fortuna's 12,516 and not far short of Arcata's 18,857, but the Census Bureau treats it as a census designated place, not an incorporated city. It sits north of Arcata and the Mad River, along the coast.
For anyone serving or filing papers, the practical facts are simple. McKinleyville has no courthouse. Humboldt County has one, in Eureka, about 11 miles south in a straight line. And the Sheriff's Civil Services office is in Eureka as well. We run McKinleyville requests from our Sacramento office, about 212 miles away, and the papers are served at the McKinleyville address.
A town without city limits
Because McKinleyville isn't incorporated, its edges are a Census line, not a city boundary. That matters when you're deciding whether an address "is in McKinleyville." The answer depends on which map you use, and a mailing address alone won't settle it.
What doesn't change is the court. Every Humboldt case type, from a small claims dispute to a probate petition, is filed at the same Clerk's Office in Eureka, so a McKinleyville plaintiff never has to sort out which branch to use. There isn't one.
Inside ZIP 95519
McKinleyville has one ZIP Code area, 95519, and it covers about 54 square miles of land. The Census Bureau's 2020 ZCTA to place relationship file splits it this way:
| Area within 95519 | Land | Share of 95519 |
|---|---|---|
| McKinleyville CDP | about 20.9 sq mi | about 38.8% |
| Fieldbrook CDP | about 10.5 sq mi | about 19.5% |
| Outside any named community | about 22.4 sq mi | about 41.7% |
| Arcata city | a tiny sliver | under 0.1% |
So a 95519 address may be a house in a McKinleyville subdivision, a home in Fieldbrook, or a parcel on a county road that belongs to neither. When it's outside the built-up area, the server needs more than a street number. A cross road, a gate description or a note about a long driveway makes the first attempt count.
The trip to I Street
Filing a McKinleyville case means getting papers to the Court Clerk's Office at 421 I Street in Eureka. The courthouse's main address is 825 5th Street, but the court directs nearly every filing and payment to the I Street entrance. Appeals are the one office that stays on 5th Street.
Clerks work the counter from 9:00 in the morning until 2:00 in the afternoon, and the drop box is available from 8:00 until 4:00. Humboldt has no e-filing at all, as the court's Online Services page states. Faxing straight to the court isn't allowed either under Local Rule 1.8; only a fax filing agency can send papers that way. For a McKinleyville filer, the choices are the counter, the drop box, the mail or an agency.
Questions go to (707) 445-7256. Press 2 for a civil, probate, small claims or eviction case, and 3 for family, juvenile or adoption matters. Our Humboldt County court filing service can carry a McKinleyville filing to I Street and serve the same case on one request.
Restraining orders from McKinleyville
Humboldt is one of the courts that lets a person start a domestic violence or gun violence restraining order request online. The court's portal accepts initial requests at any hour and processes them during business hours, which the court says can take up to 24 hours. Only first requests go through the portal. The court discards anything else sent that way, and responses, continuance requests and related papers go in person or by mail.
Once a judge signs a temporary order, the restrained person has to be personally served with it and the hearing notice before the hearing. That's the step where a server comes in. Send us:
- a recent photo of the person
- their vehicle and plate, if known
- where they live and where they work, with hours
- the hearing date and time
For civil harassment and workplace violence requests, the court's ex parte rule, Local Rule 2.9, doesn't apply to the TRO itself. General information, not legal advice.
Family cases filed by McKinleyville parents
Divorce, custody, support and adoption papers go to the Family / Juvenile / Adoptions counter at 421 I Street. The court's Self-Help Center is on the third floor of the courthouse, in Room 305, and its schedule is fuller than many rural courts offer:
- walk-in help Monday, Tuesday, Wednesday and Friday, 9 a.m. to noon
- scheduled appointments Monday through Friday, 1:00 to 4:00 p.m., booked at extension 1321
- Divorce Workshop I on Thursdays from 9:00 to 10:30 a.m., and Workshop II from 10:30 to noon
Child Custody Recommending Counseling is in Room 310 of the same building.
When a family case is filed, the other parent gets the petition and summons by personal service, wherever they live. If they've moved out of McKinleyville, to Arcata, Eureka or out of the county, give us every address you have. A server with a current workplace usually needs fewer trips.
The family counter is reached at option 3 on (707) 445-7256 and keeps the same 9:00 a.m. to 2:00 p.m. office hours as the other filing divisions. A custody or support case filed there still needs the other parent served, and that service is often the slowest step when the parent has moved off the coast. Adoption and juvenile filings from McKinleyville families go to the same family counter, and the court's divorce workshops are held in Room 305 upstairs.
Papers to serve in McKinleyville?
Small claims filed from McKinleyville
A McKinleyville small claims case goes to the Small Claims / Unlawful Detainer counter at 421 I Street, reached at option 2 on the court's phone menu. The court's small claims page links to statewide instructions and forms and doesn't name a local small claims advisor. The Self-Help Center lists small claims among the civil topics it covers.
Service has a firm window. Under CCP § 116.340, the claim must be served at least 15 days before the hearing on a defendant who lives in Humboldt County, and at least 20 days before on one who lives in another county. The person who filed the claim can't serve it. A non-party adult or a process server can, and the server then signs form SC-104, the small claims proof of service.
Count backward from the hearing date before you send the request. A defendant who works out of town, or who lives on a county road outside the built-up area, may take more than one attempt, and the 15 days have to be met after service, not after the request is sent.
Collecting a judgment from a McKinleyville debtor
Winning a judgment is one job and collecting it is another. If the debtor's assets are unknown, the next step is often a debtor examination. CCP § 708.110(d) requires the court's examination order to be personally served at least 10 days before the exam date, so it's a deadline-driven service.
Levies are the Sheriff's work, and the Humboldt Sheriff's Civil Services page publishes its fees:
| Sheriff service | Fee |
|---|---|
| Earnings withholding order | $45 |
| Bank levy | $50 |
| Till tap | $125 |
| Personal property levy | $125 |
| Real property levy | $3,000 deposit |
| Deputy witness fee, civil subpoena | $275 deposit |
| Most other papers | $50 |
The Sheriff asks for payment when the papers are dropped off at its lobby counter at 826 Fourth Street in Eureka. The counter is staffed four full days a week, Monday through Thursday, and only until 12:30 p.m. on Fridays.
If a debtor has left the area, skip tracing can look for a newer address before you pay for another attempt. Our post on skip tracing for legal cases explains the method.
When the person has left Humboldt County
The case stays in Eureka even when the defendant doesn't. A McKinleyville plaintiff suing someone who has moved to Crescent City, Weaverville or Ukiah still files at I Street; only the service happens somewhere else.
That's one place where the Sheriff and a private server differ. The Humboldt Sheriff's instructions ask for a physical address located in Humboldt County, so an out-of-county defendant means sending papers to a second sheriff's office with its own forms and fees. A private server can serve anywhere in California on the same request. If the person may be in a neighboring county, see Del Norte County, Trinity County or Mendocino County, and send every address you have.
Service rules that apply here
California lets a non-party adult serve most papers. The exceptions and the registration rules for paid servers are in who can serve papers in California. After service, the server signs a proof of service, and our proof of service guide shows what it contains.
From January 1, 2027, AB 747 amends CCP § 415.20(b). Before papers are left with another adult at the home or workplace, three good-faith tries at personal delivery, on three different days and at three different times, show reasonable diligence. The AB 747 guide has the full picture. A McKinleyville business is usually served through its agent for service of process; see serving corporations. We make no guarantees for service.
