Smith River is close to as far north as California goes on the coast. Its Census center point is about 5.3 miles south of the 42nd parallel, the California-Oregon line, and about 268 miles from our Sacramento office in a straight line. Every case from Smith River goes to one courthouse in Crescent City, about 12 miles south.
Two things make Smith River work different from a city job: the papers can involve someone across the state line, and the trip itself depends on two highways with posted construction. Both are covered below, along with the Del Norte court's schedule and local rules.
Smith River on the Census map
The 2020 Census counted 906 people in the Smith River Census-designated place, on about 4.4 square miles of land. All of that land sits in ZIP Code area 95567, according to the Census Bureau's 2020 ZCTA to place relationship file. The ZIP Code area itself is much bigger, about 62.5 square miles, and about 92.9% of it, some 58 square miles, lies outside any Census place.
When we ran Smith River's point through the Census Bureau's geocoder, it returned Del Norte County, the Smith River-Gasquet county subdivision, the Del Norte County Unified School District, and the Crescent City micropolitan area. It also returned the Brookings-Crescent City, OR-CA Combined Statistical Area: the Census Bureau treats this corner of California and the Oregon coast just north of it as one connected region.
A "Smith River, CA 95567" address, then, is far more likely to be a rural parcel than a house on a town street. Remote areas are subject to different timelines. Directions beyond the house number help most: the road, the nearest crossroad, the name on the mailbox, a gate or a long private drive.
When the person has moved to Oregon
Because Smith River sits so close to the state line, some cases involve a defendant, a witness or a former tenant who now lives in Oregon. A California case can still reach them. Under CCP § 415.40, a summons can be served on a person outside California in any manner allowed by the California service article, or by first-class mail requiring a return receipt. Mail service that way is complete on the 10th day after mailing.
Which method fits depends on the case, and on what the proof of service has to show. For a small claims case, the deadline is longer when the defendant lives outside the county: service must be completed at least 20 days before the hearing instead of 15 (CCP § 116.340). Give us every address you have on both sides of the line, and ask the attorney before deciding how an out-of-state party will be served. General information, not legal advice.
Oregon cases that need a Smith River witness
The traffic runs both ways. When a case pending in Oregon, or any other state, needs testimony or records from someone in Smith River, California's discovery act handles it through the clerk of the county where the discovery will take place. Under CCP § 2029.300, the out-of-state party submits the foreign subpoena to the Del Norte County Superior Court clerk with an application on the Judicial Council form and the fee, and the clerk issues a California subpoena carrying the out-of-state caption and case number. Asking for it doesn't count as appearing in a California court. Once issued, it's served under California rules, which for a witness who must appear means personal delivery with the travel and attendance fees offered if requested. Our post on how to serve a subpoena in California covers the details.
The courthouse in Crescent City
The Del Norte Superior Court at 450 H Street, Room 209, Crescent City, handles every case type. The Civil Division page lists office hours of 8 a.m. to 5 p.m. on weekdays, while the Forms and Filing page says the filing windows are open 8:00 a.m. to 4:30 p.m., with lobby Mailbox #31 from 4:30 to 5:00 p.m. and an outside drop box from 8:00 a.m. to 4:00 p.m. Our Crescent City page covers the after-hours filing rule, and our Del Norte County court filing page explains how a filing and a Smith River service can go on one request.
The Civil Division page also defines the case categories that decide the filing fee and the forms:
- Small claims: generally up to $12,500 for an individual.
- Limited civil: over $10,000 and up to $35,000.
- Unlimited civil: over $35,000, which the page says includes an unlawful detainer over $35,000 and a petition to change a name or gender.
The 90-day service standard
Del Norte's Local Rule 3.3 sets time standards for general civil cases, and the first one is about service. The summons and complaint must be served on all named defendants no later than 90 calendar days after the complaint is filed, though the court can extend that for good cause. Responsive pleadings follow within 30 calendar days of service, and the case management conference is set about 180 days after filing. The rule excludes evictions, small claims, family law, probate, name changes and restraining order petitions, which run on their own timelines. For a Smith River defendant who is hard to find, start service early: a rural address, a defendant who spends time in Oregon, or a highway delay can use up weeks.
Papers to serve in Smith River?
Friday is the busy day
The court's 2026 department schedule puts much of the civil calendar at the end of the week:
| Matter | When, per the 2026 schedule |
|---|---|
| Unlawful detainer and small claims | Fridays, 2:00 p.m., Department 2 |
| Civil law and motion | Fridays, 9:00 a.m. |
| Probate | Friday mornings |
| Family support | Third Tuesday, 8:30 a.m., Department 4 |
The court's 2012 local rules, still the posted rules, say in Rule 8.1(e) that civil law and motion is heard Fridays at 9:00 a.m., and that unlawful detainers are heard Mondays at 3:30 p.m. unless a standing order or court order changes it. The newer schedule shows eviction matters on Friday afternoons, so confirm the hearing date and department on the notice itself. Plan service so the proof is back and filed well before a Friday hearing.
Del Norte local rules that touch service
A few more posted rules matter when papers are being served for a Smith River case:
- Ex parte notice (Rule 7.2). Notice must reach all parties by 10:00 a.m. the court day before the ex parte appearance, unless exceptional circumstances justify less. In an unlawful detainer case, shorter notice is allowed if it's reasonable. The notice must state the relief requested and the date, time and place.
- Jury fees (Rule 7.1(a)). In an eviction, first-day jury fees are due no later than 5 calendar days before trial; in other civil cases, 25 calendar days. No fees, no jury.
- Fax filing (Rule 2.3). Civil, probate and family law documents can be faxed to the clerk at (707) 465-4005, which helps a Smith River filer who can't make the drive. The fax needs a transmission cover sheet naming a contact person, and a copy of a check for the fax charge and filing fees; the check itself must reach the clerk within 5 court days. Faxes are capped at 35 pages including the cover sheet and exhibits, and a fax filing agency can be used instead.
The court hasn't published an e-filing rule. Self-represented filers file at the counter, by mailbox or drop box, by mail or by fax.
Getting to Smith River: the highways
U.S. 101 is the coast highway through Del Norte County, and U.S. 199 links the county to inland Oregon. Caltrans posts construction delays on both. When we checked its report on October 29, 2026, at 1:00 p.m., it listed:
- U.S. 101: one-way controlled traffic at several spots in Del Norte County, including near the Klamath River Bridge, on weekdays, with delays of up to 15 minutes.
- U.S. 199: one-way controlled traffic around the clock at two spots north of Gasquet, about 6 and 9.6 miles out, with delays of up to 10 minutes.
Caltrans takes current highway questions at 1-800-427-7623. Restrictions change often, so check before a tight deadline. For a deadline close to a holiday or a storm, send the papers as early as you can.
Evictions in Smith River
A Smith River landlord files the unlawful detainer at the Crescent City courthouse. After personal service of the summons and complaint, the tenant has 10 court days to file an answer, not counting weekends and court holidays; the statewide self-help site lists longer periods when papers were left with someone else and mailed, or posted. If the tenant has already left for Oregon, the out-of-state rules above come into play.
Papers for someone in custody
Pelican Bay State Prison is near Crescent City. Serving papers on someone held there follows the facility's own rules, not the steps for a home address. Our Crescent City page explains where to start, and you should tell us up front if the person is in custody.
Service rules from 2027
From January 1, 2027, three good-faith attempts at personal delivery, on three different days and at three different times, show reasonable diligence before papers are left with another adult at a home or business (CCP § 415.20(b)(2), as amended by AB 747). For a far-north address, those attempts take planning. The county clerk's register of process servers becomes public under Business and Professions Code § 22355. See our AB 747 guide and our proof of service guide. We make no guarantees for service.
