Eureka has something most California cities don't: the courthouse, the clerk's counter and the Sheriff's civil office all sit within a block of each other. The Humboldt County Courthouse is at 825 5th Street. Filings go in at 421 I Street, on another side of the same building. The Sheriff's Office, where Civil Services now works from the main lobby, is at 826 Fourth Street, across the next street over. By the Census Geocoder's coordinates, the courthouse and the Sheriff's door are about 300 feet apart.

That makes Eureka the simplest place in the county to serve and file, and it also means every Humboldt case passes through here. Whether the papers come from McKinleyville, Fortuna or Garberville, the filing lands on I Street. We handle Eureka requests from Sacramento, about 207 miles south in a straight line, and the papers are served at the Eureka address.

Three addresses on one block

The court lists different doors for different jobs. Here's what each one does, from the court's Contact Us/Locations page and the Sheriff's Civil Services page, both read in October 2026:

How a filing day works in Eureka

The counter on I Street opens at 9:00 and closes at 2:00. That five-hour window is the main constraint on any Humboldt filing, and there is no electronic way around it. The court's Online Services page says e-filing is not available in Humboldt County. Local Rule 1.8 says the court doesn't accept direct fax filing, though a fax filing agency can file under California Rules of Court 2.300 to 2.306.

So a Eureka filing goes in one of four ways: across the counter before 2:00, in the drop box before 4:00, by mail, or through a fax filing agency. Initial domestic violence and gun violence restraining order requests are the one exception; the court takes those through an online portal, and everything after the first request has to come in person or by mail.

Ex parte work has its own clock. Local Rule 2.9 puts a civil ex parte matter on the next court day's calendar only if the papers arrive before noon. After noon, the earliest slot is two court days out. Opposition papers are due two hours before the hearing. If you need papers both filed and served on an ex parte schedule, tell us the hearing time when you send the request. Our Humboldt County court filing service can take the filing to I Street and pair it with service on one request.

Some research can happen before anyone drives to I Street. The court's Online Services page offers Online Case Access, daily calendars with remote appearance details, a research request form and transcript requests. Reviewing a paper file takes longer: under Local Rule 1.15, a viewer may ask for up to six files a day, which are ready the following court day, and a search running past ten minutes carries a fee.

Eureka mail versus Eureka city limits

Two ZIP Codes carry a Eureka mailing address, and they cover very different ground. The Census Bureau's 2020 ZCTA to place relationship file shows:

  • 95501 is about 7.3 square miles of land. About 77% is inside Eureka city and about 21% is in Myrtletown, an unincorporated community on the city's east side.
  • 95503 is far larger, about 84 square miles. Only about 4% of it is in Eureka. About 12% is Pine Hills, about 5% Humboldt Hill, and smaller shares fall in Cutten, Bayview, Indianola and Myrtletown. Roughly three quarters of 95503 is outside any city or named community.

A 95503 address can be a subdivision house south of town or a parcel on a ridge road in the hills behind it. When the address is outside the grid, give us a cross street, a gate description or a parcel number. The filing court doesn't change, since there is only one, but the effort to find the right door does.

Hearing dates, defaults and Does

Two of Humboldt's civil rules come up on Eureka cases more than people expect.

Moving a hearing. Local Rule 2.14 bars using an Amended Notice of Hearing to change a date that has already been noticed. The date moves only by a stipulation and signed order, a properly noticed ex parte application, or the court acting on its own. When that happens, any party who still needs notice must get the new date the proper way, and a fresh round of service may be part of that.

Defaults. Under Local Rule 2.13, before a default judgment is entered in any civil case, every non-defaulting party has to be dismissed first or at the same time, Doe defendants included. A plaintiff who named Does 1 through 20 and served only one real defendant needs to deal with the rest before asking for judgment.

Neither rule is about service itself, but both affect when and how papers go out. General information, not legal advice.

Eviction papers for Eureka rentals

Unlawful detainer cases are filed at the Small Claims / Unlawful Detainer counter on I Street. Two timing rules shape the work:

  1. After personal service of the summons, the tenant has 10 court days to answer.
  2. Humboldt Local Rule 2.12 says the court will dismiss the case without prejudice if proof of service of the summons isn't filed within 60 days of the complaint.

If the landlord wins, the writ of possession goes to the Sheriff, not to a private server. The Sheriff's fee schedule lists $180 for a writ of possession. Its Civil Services page also lists $45 for an earnings withholding order, $50 for a bank levy and $125 for a till tap or personal property levy.

For the summons and complaint, send the unit number, the names of every adult occupant you're serving, and anything about building access, such as a locked lobby or a manager's office.

Sheriff or private server for a Eureka address

Eureka is the one place in Humboldt where the Sheriff's civil counter is a short walk from the courthouse, so it's fair to compare the two routes.

The Sheriff asks for two copies per defendant, an original signed letter of instruction naming who is to be served and a physical Humboldt County address, and payment when the papers are dropped off. The fee is charged per person or entity served, and most papers cost $50. The office closes at 12:30 p.m. on Fridays.

A private server works from your Service Request instead. Any adult who is at least 18 and not a party to the case can serve a summons, and our guide on who can serve papers in California covers the details. From January 1, 2027, under CCP § 415.20(b)(2) as amended by AB 747, three good-faith attempts at personal delivery on 3 different days at 3 different times show reasonable diligence before papers are left with another adult. Our AB 747 guide explains the change, and the proof of service guide shows what you get back. We make no guarantees for service.

Serving a business in Eureka

Most corporations and LLCs are served through their agent for service of process, not at a storefront. Look up the entity on bizfile Online and send us the agent's name and address exactly as the Secretary of State lists them. A locally owned Eureka business often names an owner at a home address somewhere around the bay. A larger company usually names a commercial agent such as CT Corporation or CSC. Our page on serving corporations covers the rules.

If the agent listed has moved or the business has closed, skip tracing can look for a current address before an attempt is made. Our post on how to find a defendant in California explains which records that search uses.

What to put in a Eureka Service Request

  1. Upload up to 5 PDFs on the Service Request.
  2. Name each person or entity exactly as the papers do.
  3. Give the full address, with the unit or space number, and note whether it's inside city limits or out in 95503.
  4. Add a filing if the papers also need to go to I Street, and note any hearing or ex parte deadline.
  5. Choose Rush or Standard.

Around Eureka

Cutten is about 2 miles south of central Eureka, and Samoa, out on the peninsula, about 2.3. Bayside is about 5.9 miles, and Arcata about 6.3, both straight-line. Farther north, McKinleyville, an unincorporated community of about 16,000 people, is about 11 miles from the courthouse. Every Humboldt community we serve is listed on our Humboldt County page.

Where exactly do I file papers at the Eureka courthouse?

At the Court Clerk's Office, 421 I Street. The courthouse's street address is 825 5th Street, but the court's Contact Us/Locations page sends case inquiries, filings and payments to the I Street side for civil, probate, small claims, unlawful detainer, family and criminal matters. Appeals are the exception and stay at 825 5th Street. Checked October 2026.

Can I file at the Eureka courthouse after 2:00 p.m.?

Not at the counter. The Clerk's Office keeps 9:00 a.m. to 2:00 p.m. The court's drop box takes documents from 8:00 a.m. to 4:00 p.m., so papers that reach I Street after the counter closes can still be left the same day. The court has no e-filing, and Local Rule 1.8 rules out direct fax filing; a fax filing agency is the only fax route.

I need an ex parte hearing in Humboldt. When do the papers have to be in?

Under Humboldt Local Rule 2.9, civil ex parte papers received before noon go on the next court day's calendar. Papers received after noon wait until two court days out. Any opposition is due two hours before the hearing. The rule doesn't cover family law, or civil and workplace harassment TRO requests. General information, not legal advice.

My hearing date moved. Can I just serve an amended notice of hearing?

Not in Humboldt. Local Rule 2.14 says a noticed hearing date can change only by a stipulation with a signed order, a properly noticed ex parte application, or the court on its own. An Amended Notice of Hearing can't be used to move a date. Once a new date is set, plan service around it.

Will the Humboldt County Sheriff serve papers at a Eureka address?

Yes, if you meet its requirements. Civil Services, now at the main counter in the lobby of 826 Fourth Street, asks for 2 copies per defendant, an original signed letter of instruction with a physical Humboldt County address, and payment at drop-off. Most papers cost $50 a person. Hours are Monday to Thursday 8 a.m. to 4 p.m. and Friday 8 a.m. to 12:30 p.m.

Is a 95503 address inside Eureka city limits?

Usually not. The Census Bureau's 2020 ZCTA to place file puts only about 4% of 95503's land inside Eureka. Most of it lies outside any city or named community, and the rest is spread over Pine Hills, Humboldt Hill, Cutten, Bayview, Indianola and Myrtletown. The filing court is the same either way; the difference shows up when a server looks for the door.

What happens if an eviction in Eureka goes 60 days without a proof of service?

Humboldt Local Rule 2.12 says the court will dismiss the unlawful detainer without prejudice if proof of service of the summons isn't filed within 60 days of the complaint, citing CCP § 1167.1. Get service done early and file the proof promptly. General information, not legal advice.

Is there help at the Eureka courthouse for someone filing small claims without a lawyer?

The court's small claims page links to statewide guides and doesn't name a local small claims advisor. Its Self-Help Center, in Room 305 at 825 5th Street, lists civil topics including evictions, name changes and small claims. Walk-in help runs Monday, Tuesday, Wednesday and Friday from 9 a.m. to noon, with appointments in the afternoon at extension 1321. Staff can't give legal advice.
