San Marcos sits in the middle of North County, between Escondido and Vista, and its cases split between two San Diego Superior Court buildings that are about 33 miles apart. Knowing which one a case belongs to tells you where the papers get filed, where the hearing is, and how much lead time the service needs. Below is that split for San Marcos, plus the practical details that come up when a server goes to a San Marcos address.
We serve summonses, complaints, subpoenas, family law papers, eviction papers and every other kind of legal document on people and businesses in San Marcos. We can also file the case first and serve the conformed copies after.
Which San Diego courthouse takes a San Marcos case
The San Diego court sorts cases by ZIP Code. Its ZIP Code List, form ADM-254 (Rev. 1/25), assigns all of San Marcos to the North County Division: 92069 and 92078 for most homes and businesses, 92079 for post office boxes, and 92096, which the list marks as belonging to Cal State San Marcos. The exceptions printed on the back of that form are what move some case types out of Vista.
- Limited and unlimited civil: North County Regional Center, 325 South Melrose Drive, Vista. That's about 6.3 miles in a straight line from the city's Census center point.
- Unlawful detainer (eviction): Hall of Justice, 330 West Broadway, Room 225, San Diego, about 29 miles south. Local rule 2.4.2(A) treats North County as part of Central for every eviction.
- Small claims: Hall of Justice as well, under local rule 2.4.4(A).
- Family law: North County Regional Center, with exceptions for child support cases brought by the Department of Child Support Services and a few others that go to Central.
- Probate: documents may be filed in Central or North County under local rule 4.1.2(A), but the North County option is a drop box. The probate office itself is at the Central Courthouse, 1100 Union Street.
Civil filings for San Marcos go to Vista
A contract dispute, a collection case, a personal injury suit or any other limited or unlimited civil case from a San Marcos ZIP Code is filed at the North County Regional Center. The court describes that building as a full service branch, shared with the Sheriff, Probation and the District Attorney, with venue over most of northern San Diego County. The civil business office there is open 8:30 a.m. to 4:00 p.m. on weekdays, and its phones are answered from 8:30 to 11:30 a.m. only, so plan calls for the morning.
Attorneys don't walk most civil filings in anymore. Local rule 2.1.4 requires attorneys for represented parties to e-file in every limited and unlimited civil case type, through one of the court's approved e-filing service providers, with a short list of exempt documents. Self-represented parties may still file on paper.
Two things often get missed on a new San Marcos civil case:
- The service packet is bigger than the summons and complaint. The court's civil e-filing page puts the duty on the plaintiff to serve its e-filing General Order and form CIV-409 with the complaint. Upload both with the rest of the papers so the server delivers one complete set.
- Filings may take a while to show up. The civil division moved to a new case management system and posts a notice about a significant backlog in all filing types. It asks filers not to call about a submission that has been pending for less than a month. Build that into any plan that needs a conformed summons before service can start.
Evictions and small claims from San Marcos go downtown
Landlords in San Marcos are sometimes surprised that the courthouse 6 miles away won't take their case. The court's landlord and tenant page is plain about it: every unlawful detainer is filed in the Civil Business Office at the Hall of Justice. The office is open 8:30 a.m. to 4:00 p.m., and many of its phones are answered only from 8:30 to 11:30 a.m.
Small claims follows the same path. The court's small claims FAQ says every claim in the county is delivered to the Hall of Justice, Room 225, either by mail or at the drop box inside on the second floor. The same FAQ caps claims at $12,500 for an individual or sole proprietor and $6,250 for a corporation, partnership or other entity. It also says the plaintiff can't complete service personally, which is where a process server comes in.
For an eviction summons, the method of service decides the clock. The California Courts self-help guide gives a tenant 10 court days to answer after personal delivery. After substituted service or posting, the tenant gets 10 calendar days from the date the papers were mailed, and then 10 court days. If you're counting toward a default, the proof of service has to show which method was used and the mailing date where there was one. Posting a summons on the property isn't a shortcut: under CCP § 415.45 the landlord first shows the court by affidavit that reasonable diligence failed, and the court then orders the posting and a certified mailing.
Papers to serve in San Marcos?
Family law, probate and adoptions for San Marcos residents
A San Marcos divorce, legal separation, custody or support case is filed at the North County Regional Center under the ZIP Code List. The family business office keeps the same hours as civil, 8:30 a.m. to 4:00 p.m., with morning phone hours. Local rule 5.1.5(C) sends three kinds of family matters to Central instead: surrogacy, disposition of embryos, and cases involving the Department of Child Support Services.
The petitioner can't serve the respondent. Another adult who isn't a party has to do it, and for the first papers in a family case the proof is usually form FL-115. Send the hearing date with the request when there is one, so attempts can be planned to finish well before it.
Probate is the split that trips people up. The court's probate page lists the North County Regional Center as a first-floor drop box only, open 8:30 a.m. to 4:00 p.m., while the business office, the examiners and the probate departments are at the Central Courthouse at 1100 Union Street. Mail goes to Central. Adoptions follow the ZIP Code List under local rule 6.2.1, so a San Marcos adoption is a North County filing.
Restraining orders for San Marcos
Civil harassment and elder or dependent adult abuse restraining orders follow the ZIP Code List rather than the general civil exceptions, so a San Marcos request is filed in Vista rather than downtown. Once the court sets a hearing, that date is the limit on how long the server has to deliver the papers to the restrained person. Send a recent photo, the person's work schedule, any vehicle you know of and the hearing date, so the attempts are spread over the days that are left instead of bunched at the end.
San Marcos ZIP Codes and the unincorporated edges
The ZIP Codes on a San Marcos address don't line up neatly with the city limits. The Census Bureau's 2020 ZCTA to place relationship file shows how much land in each one is inside the city:
- 92069 is the city's northern ZIP Code. Only about 56% of its land is inside San Marcos, and the remaining 44% is in no city at all. Addresses in the hills north and east of town can carry a San Marcos mailing address while sitting on county land.
- 92078 covers the south side and is about 79% city. It also takes in about 10% that is the Lake San Marcos community and about 6% in Harmony Grove, both unincorporated, plus a small sliver of Carlsbad.
- 92096 is a small area entirely inside the city. The court's list ties it to Cal State San Marcos.
None of this changes the court. Every one of those ZIP Codes is North County on form ADM-254. It can change how service goes. Rural lots north of town may sit behind a shared private road or a gate at the street, and a lakeside or gated community may need a resident to let the server in. A gate code, a cross street or a photo of the driveway saves an attempt. A 92079 post office box isn't a place where papers can be handed to anyone, so if that's all you have, ask about skip tracing for a street address first.
Serving at Cal State San Marcos and other large sites
A university campus is a workplace, and people can be served at work. The trouble is finding them. Give the building, the department or office, the person's role and the hours they are usually there. Students are harder to place than staff, so a home address is usually the better first try for a student.
The same advice fits the city's business parks and retail centers. The person at a front desk often can't accept papers for a company. For a corporation or LLC, look up the agent for service of process on the Secretary of State's bizfile Online and send that name and address with the request. Many companies name a commercial agent far from San Marcos. Our pages on CSC Lawyers Incorporating Service and CT Corporation cover the two most common, and serving corporations explains the general rules.
Subpoenas, records and a filing on the same request
For a deposition or trial subpoena, send the subpoena, any attachments and the date by which service has to be complete. Witness fees and notice periods depend on the type of subpoena. Our post on how to serve a subpoena in California lists the common ones.
If the case still needs to be filed, add the filing to the same Service Request and say which building it belongs in: Vista for civil and family, downtown San Diego for an eviction or small claim. Conformed copies come back before service starts. We can also pull copies of filed documents through document retrieval.
