Del Mar is a coastal city of about 3,900 residents, and it has an unusual court assignment. It sits on the coast north of the city of San Diego and south of Solana Beach, closer to Vista's North County courthouse than many people expect, yet its lawsuits are filed downtown. Getting that right is the first step in any Del Mar case, because the filing location decides where the conformed summons comes from before anyone can be served.
We serve summonses, complaints, subpoenas, eviction papers, family law papers and other legal documents at Del Mar homes, rentals and businesses, and we can file the case downtown on the same request.
Where Del Mar cases are filed
The San Diego court assigns most case types by ZIP Code. Del Mar has a single ZIP Code, 92014, and the court's ZIP Code List (form ADM-254, Rev. 1/25) assigns it to the Central Division. Here is what that means by case type:
- Limited and unlimited civil: the Civil Business Office in the Hall of Justice, 330 West Broadway, Room 225, San Diego. That's about 18 miles from the city's Census center point in a straight line.
- Unlawful detainer: the same office. Every eviction in the county is filed there.
- Small claims: also the Hall of Justice, Room 225, by mail or at the second-floor drop box.
- Family law: the Central Courthouse, 1100 Union Street, next door to the Hall of Justice.
- Probate: the Central Courthouse, third floor.
- Adoptions: the Juvenile Court at 2851 Meadow Lark Drive, which form ADM-254 says is what "Central" means for adoptions under local rule 6.2.1.
The North County Regional Center in Vista is about 15.6 miles away, a little closer than downtown. It doesn't take Del Mar civil or family filings.
Why Del Mar tickets go to Vista but its lawsuits don't
The back of form ADM-254 lists the court's exceptions to the ZIP Code List, and two of them name Del Mar. Under local rule 1.2.2(H)(2), criminal cases arising in Del Mar are filed in the North County Division. Under local rule 1.2.2(I), adult traffic cases arising in Del Mar are filed there too. Coronado gets the mirror treatment, with its criminal and traffic cases sent to South County.
Neither exception reaches civil, family, probate or small claims. So a Del Mar resident may have been to the Vista courthouse for a citation and assume a lawsuit belongs there as well. It doesn't. A complaint against a Del Mar defendant goes to the Hall of Justice, and if it's filed at the wrong branch the case gets transferred, which adds a new case number and delay.
A 92014 address isn't always Del Mar
The 92014 ZIP Code reaches well beyond the city. The Census Bureau's 2020 ZCTA to place relationship file breaks its land down this way:
- About 27% is inside the city of Del Mar.
- About 50% is inside the city of San Diego.
- About 7.5% is inside Solana Beach.
- About 16% isn't in any city.
For the court, this rarely matters, since all of 92014 is Central for civil and family filings. For service it can. An address that reads "Del Mar, CA 92014" may be in a city of San Diego neighborhood a few miles inland, or in the southern part of Solana Beach. Check the street address on a map before you send it, and if the person has moved within 92014, give us both addresses.
Filing a Del Mar civil case at the Hall of Justice
The court describes the Hall of Justice as home to its Civil Independent Calendar courtrooms, the Civil Business Office and the Small Claims Business Office. The civil business office is open 8:30 a.m. to 4:00 p.m. on weekdays, and many of its phones are answered only between 8:30 and 11:30 a.m.
Attorneys rarely stand in that line. Local rule 2.1.4 requires attorneys for represented parties to e-file all limited and unlimited civil cases through an approved provider, with certain documents excepted. Self-represented parties don't have to e-file.
Before you send papers out for service, check the packet. The court's civil e-filing page puts it on the plaintiff to serve the e-filing General Order and form CIV-409 with the complaint. Those two documents belong with the summons in the PDFs you upload. The same page warns that the civil division moved to a new case management system and has a significant backlog in every filing type, and it asks people not to call about a filing until it has been pending for a month. If you're waiting on an issued summons, factor that in.
Del Mar evictions
Landlords file every Del Mar unlawful detainer at the Hall of Justice. The court's landlord and tenant page lists a single counter for the whole county, the Civil Business Office in Room 225, open 8:30 a.m. to 4:00 p.m. It also notes that a person seeking a same-day civil restraining order must be in line with completed papers by 3:00 p.m.
How the summons is served sets the tenant's deadline. According to the California Courts self-help guide, a tenant served by personal delivery has 10 court days to answer. With substituted service, or with posting and mailing, the tenant has 10 calendar days from the date of mailing and then 10 more court days. Posting itself needs the court's permission first. CCP § 415.45 lets the court order the summons posted on the premises, with a certified mailing, only after an affidavit shows that reasonable diligence didn't succeed.
For a rental, give us the unit, the names of every adult on the lease, and the property manager's contact if someone else handles the building. A guest house or a unit over a garage often has its own entrance that doesn't show on a map, so describe it.
Papers to serve in Del Mar?
Small claims involving Del Mar
Small claims from Del Mar are filed at the Hall of Justice, Room 225. The court's small claims FAQ sets the limit at $12,500 for an individual or sole proprietor and $6,250 for a corporation, partnership or other entity. It adds a limit that catches frequent filers: no more than two claims anywhere in California for more than $2,500 each in a calendar year.
A few other points from the same FAQ are worth knowing before a Del Mar claim is filed:
- A business using a fictitious name has to put its statement number and expiration date on the claim.
- A corporation is represented at the hearing by a regular employee, not someone hired just for the case.
- A claim against a government agency usually needs a formal claim to the agency first, generally within six months.
- The plaintiff can't serve the defendant personally.
Self-represented Del Mar plaintiffs can get free help from the court's Small Claims Legal Advisor before filing. The advisor's page lists a 24-hour recorded information line at (858) 634-1900, a phone line at (858) 634-1777 and an in-person clinic at the Hall of Justice. Clinic visits are capped at six consultations in any 30-day period, so bring the contract, receipts and messages to the first one.
Family law, probate and adoptions downtown
A Del Mar divorce, custody, support or parentage case is filed at the Central Courthouse at 1100 Union Street, which the court says opened in late 2017 as its consolidated building for criminal, probate, family, appeals and administration. The Family Court Business Office is in Room 450 on the 4th floor, open 8:30 a.m. to 4:00 p.m., with phones answered from 8:30 to 11:30 a.m. The Family Law Facilitator is in Room 480 on the same floor.
The respondent can't be served by the petitioner. Another adult who isn't a party does it, and the proof for a family law summons is usually form FL-115. For a restraining order, send the hearing date with the papers so the attempts finish ahead of it.
Probate is on the third floor of the Central Courthouse, in Room 330, open 8:30 a.m. to 4:00 p.m. The court's probate page says the examiners take phone calls from 10:00 to 10:30 a.m. and that all mailed correspondence goes to Central. We serve probate notices and citations on heirs at Del Mar addresses and can deliver filings to the probate office.
Copies of Del Mar court records
If you need a copy of something already in a Del Mar file, such as a prior judgment, a proof of service or an old complaint, the Central Records office is on the 14th floor of the Central Courthouse, Room 1460. The court's Central Division hours sheet lists it as open 8:30 a.m. to 4:00 p.m. on weekdays, with phones answered from 8:30 to 11:30 a.m. We can request the copies for you and send them with the request or on their own.
Subpoenas to Del Mar witnesses and businesses
A subpoena for a Del Mar witness needs the subpoena itself, any attachment it references, the witness's address and the date of the deposition or hearing. When the subpoena asks a Del Mar business for records, it's directed to that business's custodian of records. Witness fees and notice rules vary by subpoena type. Our post on how to serve a subpoena in California goes through them.
Serving people and businesses in Del Mar
A few habits save time at Del Mar addresses:
- Homes behind a gate. Tell us the call-box name or a code you're allowed to share.
- Owners who don't live at the property. If the person you need owns a Del Mar property but lives elsewhere, send the other address too.
- Businesses. For a corporation or LLC, find the agent for service of process on bizfile Online and give us that name and address. The agent may be a commercial agent outside the county. Our pages on CSC Lawyers Incorporating Service, CT Corporation and serving corporations explain the rules.
When an address doesn't work, skip tracing can look for a current one, and document retrieval can pull copies of anything already filed downtown.
