Solana Beach is a small coastal city between Encinitas and Del Mar, and it has a court quirk that most of its neighbors don't. Its two ZIP Codes are assigned to different divisions of the San Diego Superior Court. For anyone filing a case, that decides which building gets the papers. For anyone serving one, it decides where the conformed copies come from and how long the round trip takes.
We serve summonses, complaints, subpoenas, family law papers, eviction papers and other legal documents on people and businesses at Solana Beach addresses. We can file the case as well, at whichever courthouse the ZIP Code calls for.
Two ZIP Codes, two court divisions
The court's ZIP Code List, form ADM-254 (Rev. 1/25), is the document that controls this. On it:
- 92075 (Solana Beach) is assigned to the North County Division, whose courthouse is the North County Regional Center at 325 South Melrose Drive, Vista. From the city's Census center point that's about 13.7 miles in a straight line.
- 92014 (Del Mar) is assigned to the Central Division. Civil cases there are filed at the Hall of Justice, 330 West Broadway, and family and probate matters at the Central Courthouse, 1100 Union Street. Both are in downtown San Diego, about 20 miles south.
Most of the city is 92075. According to the Census Bureau's 2020 ZCTA to place relationship file, about 86% of the land in 92075 is inside Solana Beach, about 13% is in Encinitas and a sliver is in the city of San Diego. The 92014 ZIP Code is mostly outside Solana Beach: only about 7.5% of its land is in the city, with about 27% in Del Mar, about half in the city of San Diego and about 16% in no city at all. So a "Solana Beach" address in 92014 is usually in the southern part of town, toward Del Mar.
The court's where-to-file page says to use the ZIP Code or city where the person or company you're suing lives or does business, or where the incident happened. A plaintiff living in 92075 doesn't decide the venue by their own address.
What files where, by case type
The exceptions on the back of form ADM-254 change the picture for some case types, and two of them apply no matter which ZIP Code the Solana Beach address uses.
- Limited and unlimited civil. Follows the ZIP Code. 92075 goes to Vista; 92014 goes to the Hall of Justice, Room 225. Local rule 1.2.2(E) folds East and South County into Central for civil, but leaves North County separate.
- Unlawful detainer. Always the Hall of Justice. Local rule 2.4.2(A) includes North County in Central for evictions.
- Small claims. Always the Hall of Justice, under local rule 2.4.4(A).
- Family law. Follows the ZIP Code: North County Regional Center for 92075, Central Courthouse for 92014. Surrogacy, embryo and Department of Child Support Services matters go to Central under local rule 5.1.5(C) either way.
- Probate. Local rule 4.1.2(A) allows Central or North County, but the probate office and the examiners are at the Central Courthouse. North County has only a drop box.
- Civil harassment and elder or dependent adult abuse restraining orders. These follow the ZIP Code List, so they track the address the same way family cases do.
Filing a Solana Beach civil case
Attorneys must e-file every limited and unlimited civil filing through an approved e-filing service provider under local rule 2.1.4, and the court's provider list covers both the Central and North County divisions. Self-represented parties may still file on paper and are encouraged to e-file.
The court's civil e-filing page also says the plaintiff has to serve a copy of the e-filing General Order and form CIV-409 along with the complaint. Put both in the PDFs you send with the Service Request. When those two pages are missing, the set the defendant receives isn't the one the court expects.
The same page carries a notice that the civil division has moved to a new case management system and is working through a significant backlog in all filing types. It asks filers to wait a month before asking about a pending filing. If service can't start until the summons is issued, plan around that delay.
When a Solana Beach case lands in the wrong branch
Because the city straddles two divisions, a filing sometimes goes to the wrong one. The court's civil e-filing FAQ says the clerks can't move a submission from one branch to another. Unless there's a legal reason to reject it, the clerk opens the new case where it was filed and then transfers it to the right location. The court mails the plaintiff an order along with a new Notice of Case Assignment and a new case number.
That matters for service. If the transfer happens after you've sent papers out, the set the server is carrying may show the old case number and the old branch. Tell us right away if you get a transfer notice, and send the new Notice of Case Assignment so it can go out with the summons if the case still needs to be served. The FAQ also lists which branches take civil e-filings: Central accepts limited, unlimited and unlawful detainer cases, while North accepts limited and unlimited civil only.
Papers to serve in Solana Beach?
Evictions in Solana Beach
Every Solana Beach eviction, from either ZIP Code, is filed at the Civil Business Office in the Hall of Justice, which is open 8:30 a.m. to 4:00 p.m. on court days. Many of its phones are answered only between 8:30 and 11:30 a.m.
The time a tenant has to respond depends on how the summons was served. The California Courts self-help guide gives 10 court days after personal service, leaving out weekends and court holidays. After substituted service, or after posting and mailing, the tenant gets 10 calendar days counted from the mailing and then 10 court days. That's why the proof of service needs the method and the mailing date spelled out.
For an apartment, condo or duplex, give the unit number, the building if there is more than one, any gate or call-box code you're allowed to share, and every adult named on the lease. Each tenant who is a defendant needs their own copy.
Small claims for Solana Beach
The court's small claims FAQ says every claim in the county is filed at the Hall of Justice, Room 225, by mailing the form or by putting it in the drop box inside on the second floor. An individual or sole proprietor can claim up to $12,500. A corporation, partnership or any other entity is limited to $6,250. Attorneys can't represent either side at the hearing.
Service is the plaintiff's job, but not by the plaintiff's own hand. The FAQ says the person suing can't complete service and points to the court's proof of service page for the ways to do it. Tell us the hearing date when you send the claim so the server has room for more than one visit.
The court's Small Claims Legal Advisor answers questions by phone at (858) 634-1777, Monday through Friday from 8:30 a.m. to 12:30 p.m. and 1:30 to 4:30 p.m. There's also a walk-in clinic at the Hall of Justice, Monday through Thursday from 8:30 to 10:30 a.m., first come, first served, with consultations capped at 30 minutes. The advisor can't serve papers, but can help a self-represented plaintiff check the claim before it goes out.
Family law and restraining orders
For a divorce, custody, support or parentage case, the first question is the same ZIP Code question. A respondent at a 92075 address is a North County case at the Vista courthouse; a 92014 address is a Central case at 1100 Union Street, where the family business office keeps 8:30 a.m. to 4:00 p.m. hours. The petitioner can't serve the other party personally. The server's proof of service of summons in a family case is usually form FL-115.
For a restraining order, send the hearing date, a recent photo, the person's work schedule and any vehicle description. The papers have to be delivered before the hearing, so the attempts need to start early.
Adoptions, probate and estate papers
Adoptions are another place the two ZIP Codes part ways. Under local rule 6.2.1 an adoption is filed in the Central or North County Division according to the ZIP Code List, and for adoptions "Central" means the Juvenile Court at 2851 Meadow Lark Drive in San Diego rather than the downtown buildings. A 92075 family files in Vista; a 92014 family files on Meadow Lark Drive.
Probate doesn't split the same way in practice. The court's probate page puts the business office on the third floor of the Central Courthouse, open 8:30 a.m. to 4:00 p.m., with the office phone answered from 8:30 to 11:30 a.m. and the probate examiners reachable by phone from 10:00 to 10:30 a.m. We serve probate notices and citations on heirs and interested people at Solana Beach addresses, and we can deliver the filing downtown on the same request.
Subpoenas for Solana Beach witnesses
For a deposition, records or trial subpoena, send the subpoena with every attachment, the witness's name and address, and the date service has to be finished. A records subpoena to a business goes to the custodian of records at that business. Our post on serving a subpoena in California lists the notice periods and fees for the common types.
Serving businesses on the coast
When the defendant is a business with a Solana Beach storefront or suite, start by working out what kind of business it is. For a sole proprietor, the owner can be served at the shop. For a corporation or LLC, look up the agent for service of process on the Secretary of State's bizfile Online and give us that name and address. A company with a storefront in Solana Beach may list an agent in another city entirely. If the agent is CSC or CT Corporation, our pages on CSC Lawyers Incorporating Service and CT Corporation explain how those work, and serving corporations covers the rest.
When a business has closed or moved, our post on finding a defendant in California lists what to gather first, and skip tracing can look for a current address.
