Los Gatos is an incorporated town in Santa Clara County whose mailing area runs up into unincorporated hills along the Santa Cruz County line. It had 33,529 residents at the 2020 Census, and the Census Bureau puts it at 32,576 for July 2025. We serve summonses, complaints, subpoenas, small claims, family law papers, probate notices and eviction documents at homes and businesses in town and in the unincorporated hills around it.
Los Gatos requests are handled from our Sacramento office, about 99 miles away. Papers and instructions come in online, and the server makes the attempts at the Los Gatos address.
San Jose courthouses for Los Gatos cases
Los Gatos has no courthouse. Every civil filing from the town travels to downtown San Jose, where the county keeps its civil, family and probate clerks within a block of each other on North First Street.
| Los Gatos matter | Where it's filed | Straight-line miles from central Los Gatos |
|---|---|---|
| Limited or unlimited civil | Downtown Superior Court, 191 N. First St. (Local Civil Rule 1.C) | 8.2 |
| Unlawful detainer | Downtown Superior Court (Local Civil Rule 13.C) | 8.2 |
| Small claims, filing and hearing | Downtown Superior Court (Local Civil Rule 19.A) | 8.2 |
| Probate | Probate Clerk's Office, Room 107, Downtown Superior Court | 8.2 |
| Family law | Family Justice Center Courthouse, 201 N. First St. | 8.3 |
Distances run from the Census Bureau's internal point for Los Gatos to the coordinates on each courthouse page. Court facts were checked on santaclara.courts.ca.gov in October 2026.
The Downtown Superior Court keeps a lobby drop box for civil documents during building hours, 8:00 a.m. to 5:00 p.m. on weekdays. The clerk's counter and phones close earlier, at 3:00 p.m. Monday through Thursday and at noon on Friday. A filing that needs a clerk's attention on a Friday has to be in the building before lunch.
Attorneys must e-file civil, family and probate cases. The court's e-filing page lists the papers it still takes on paper, including abstracts, writs, ex parte filings and sister-state judgments. A self-represented Los Gatos party can file on paper or consent to e-filing. Our Santa Clara County court filing service can handle the trip or the e-filing and then serve the filed papers on the same request.
Serving the Town of Los Gatos
Claims and lawsuits against local government are their own category. The Town's Clerk Department page lists, among the Town Clerk's duties, receiving "claims, subpoenas, summons, appeals, petitions, and suits related to Town government." The Office of the Town Clerk is a division of the Town Manager's office, and the Town gives its address as 110 E. Main St., Los Gatos, CA 95030.
That matches state law. CCP § 416.50 lets a summons on a public entity be delivered to its clerk, secretary, president, presiding officer or other head of its governing body. Three practical points:
- Name the entity correctly. It's the Town of Los Gatos, not the City.
- A government claim usually comes first. A damages suit against the Town normally follows a claim filed with the Town and a decision on it. That's a step for your attorney, not the server.
- Records requests aren't service. The same office runs public records requests through an online portal. A records request doesn't serve anything.
Police records are a separate desk; the clerk page lists 408-354-5257 for them. Water, sewer and fire records belong to other agencies, which the page also lists.
Three ZIP Code areas and where they stop
A Los Gatos mailing address covers far more ground than the town. The Census Bureau's 2020 relationship file shows how the land splits:
- 95030: about 29% inside Los Gatos, about 15% inside Monte Sereno and about 55% outside any city. A sliver reaches Saratoga.
- 95032: about 46% Los Gatos and about 53% unincorporated, with small pieces in Campbell and San Jose.
- 95033: the mountain ZIP Code area. Only a few acres are inside the town. About 93% is outside any city or named community, about 5% is the Lexington Hills area, and small pieces fall in the Lompico area and Palo Alto city land.
The Census places Lexington Hills in Santa Clara County and Lompico in Santa Cruz County. So a "Los Gatos, CA 95033" address can sit on either side of a county line. That doesn't change how we serve a person. It can change which superior court a case belongs in, and which county's sheriff, assessor or recorder you deal with. Look up the parcel before you file, and copy the address on the papers exactly as written. Census ZIP Code areas approximate postal ZIP Codes.
Mountain addresses: what the server needs
The unincorporated hills above Los Gatos are where attempts slow down. On a mountain parcel the house may not be visible from the road, and a mailbox at the turnoff can be some distance from the door it belongs to. Remote areas are subject to different timelines, and these details shorten them:
- A map pin or GPS point. Street numbers on mountain roads can be hard to see, and a pin takes the guesswork out.
- Gate details. A locked gate, a call box, a code, or a shared private road with its own gate.
- The driveway. Steep, unpaved, shared with a neighbor, or marked only by a number on a post.
- Who lives on the parcel. Name the adults, and say which structure is theirs if there's a guest house or second unit.
- A weekday location. If the person works in town or down the valley, a workplace gives the server a second place to try.
If a Rush deadline depends on a 95033 address, call 855-582-5776 before you choose Rush. We'll tell you what's realistic.
Papers to serve in Los Gatos?
The 2027 rules on a hillside address
AB 747 changes substituted service from January 1, 2027. A party shows reasonable diligence by attempting personal delivery in good faith on at least three occasions, on three different days, at three different times (CCP § 415.20(b)(2)). After that, the papers can be left with a competent adult at the home and mailed, and service is complete on the 10th day after the mailing. AB 747 also has the proof of service include a photo of each attempt, stamped with its date, time and GPS coordinates.
For a valley-floor apartment, three visits fit into a normal schedule. For a house at the end of a mountain road, each visit is its own trip, which is why a second address matters so much. Our AB 747 guide has the full set of changes, and our proof of service guide shows what the signed form contains. We make no guarantees for service.
Los Gatos evictions in San Jose
Local Civil Rule 13.C sends every unlawful detainer in Santa Clara County to the Downtown Superior Court, and Rule 13.D assigns them all to one eviction department. The schedule is fixed by the rule: noticed motions at 9:15 a.m., court trials at 8:45 a.m., and post-judgment claims of right to possession at 9:15 a.m., all on Wednesday, Thursday and Friday. Jury trials go to any available department in the same building.
Two ex parte applications don't go online. A request for judgment on a stipulation and an application to stay an eviction are presented in person at the clerk's office during regular hours, and the clerk directs the applicant to a department. Other ex partes are submitted electronically. If no one asks to set trial within 60 days of the complaint, the rule lets the court dismiss on its own motion.
For the service itself, send the summons, the complaint and the notice, the name of every adult occupant, and the unit and gate details. A tenant handed the summons has 10 court days to respond, per the state court self-help page, and the clock runs differently when the papers are left with someone else or posted.
Divorce and custody papers at the Family Justice Center
A Los Gatos family law case is filed next door to the civil courthouse, at the Family Justice Center Courthouse, 201 N. First Street. The court's page for the building lists family law, juvenile dependency, traffic and drug court there, along with the court's Self-Help Center. Its drop box is inside, just past the metal detector and before the elevators, open 8:00 a.m. to 5:00 p.m. on weekdays. There's no outside box. The family clerk's phone, (408) 534-5711, keeps the same 3:00 p.m. and Friday-noon cutoffs as the civil desk.
Once the petition is filed, the respondent gets served wherever they're living now, in Los Gatos or anywhere else. Send the filed petition and summons, the blank response form and a recent photo if the household has several adults.
Small claims from Los Gatos
Rule 19.A sends a small claims action to the Downtown Superior Court when the defendant lives in the county, the contract was made or to be performed there, or the injury or damage happened there. The clerk sets every hearing in the same building. An individual can claim up to $12,500, and a business other than a sole proprietorship up to $6,250, according to the court's small claims page. The same page notes that a claimant can file only two claims over $2,500 anywhere in California in a calendar year.
Service is where cases stall. Rule 19.D(2) offers certified mail by the clerk, but an unsigned receipt means no service. Personal service by an adult who isn't a party, such as our server, comes back with a signed proof, and Rule 19.D(3) lets a plaintiff who couldn't serve in time ask the clerk for a later date at least one court day before the hearing.
Serving a Los Gatos business
For a corporation or LLC with an office or storefront in Los Gatos, look up the agent for service of process on the Secretary of State's bizfile Online and send us the agent's name and address as listed. A small local business often lists its owner. A larger company usually lists a commercial agent such as CSC or CT Corporation. Our serving corporations page covers officers and out-of-state companies.
When an address turns out to be stale, skip tracing can look for a current one. Our post on how to find a defendant in California walks through the options.
