Valpro Attorney Services serves legal papers in Monte Sereno, the small Santa Clara County city next to Los Gatos. We serve summonses, subpoenas and every other legal document at Monte Sereno homes, and we file the matching documents with Santa Clara County Superior Court in San Jose. Monte Sereno is just under 100 miles from our office.
Upload the papers on a Service Request, up to 5 PDFs, or email them to Service@ValproAttorneyServices.com. For a near deadline, call 855-582-5776, weekdays 8:30 a.m. to 5 p.m.
A city with no business district
Monte Sereno is unusual even among small cities. The city's About page says it didn't grow from a crossroads or a historic village, so a commercial core never developed, and the city is strictly residential. It incorporated in 1957 in response to annexation pressure from surrounding cities. The city puts its size at about 1.6 square miles and its population at about 4,000. City Hall is at 18041 Saratoga-Los Gatos Road.
For papers, that shapes three things:
- Almost every service is at a home. With no shopping district or office parks, there's rarely a workplace inside city limits. A defendant who works elsewhere is often easier to reach at their job, so send a work address if you have one.
- Claims against the city name the City of Monte Sereno. Ask your attorney whether a government claim has to come first.
- Police matters go through a department shared with Los Gatos, covered below.
Police service shared with Los Gatos
Monte Sereno doesn't run its own police force. Its public safety page says the city partners with the Town of Los Gatos, and the Los Gatos-Monte Sereno Police Department serves both. The page lists an authorized staff of 39 sworn officers and 20 civilian employees, led by an operations captain and a support services captain, and about 150 active volunteers.
When a Monte Sereno case needs a police report, body camera footage or an officer's testimony, the subpoena goes to the Los Gatos-Monte Sereno Police Department. Our post on serving a subpoena in California covers the steps, and we serve records custodians as well as individual witnesses.
ZIP Code 95030: one code, several jurisdictions
Monte Sereno has no ZIP Code of its own. It sits inside 95030, which it shares with Los Gatos. In the Census Bureau's 2020 relationship file, 95030 has about 10.5 square miles of land, divided like this:
| Part of 95030 | Land area |
|---|---|
| Town of Los Gatos | about 3.0 sq mi |
| City of Monte Sereno | about 1.6 sq mi |
| City of Saratoga | about 0.05 sq mi |
| No city or Census place | about 5.8 sq mi |
So a 95030 address can be in Monte Sereno, in Los Gatos, or in unincorporated county land in the hills. All of it is Santa Clara County, so the court doesn't change, and the server goes to the street address either way. The city matters only when the city itself is involved, as in a claim, a code dispute or a police records request.
If the home sits back from the road on a shared or private driveway, the house number isn't posted at the street, or there's a gate, tell us the gate code, a description of the house and where to park.
Santa Clara County courthouses for Monte Sereno
Santa Clara County Superior Court sends each kind of case to one building, and both buildings a Monte Sereno filer is likely to need sit side by side on North First Street in downtown San Jose. Straight-line distances from Monte Sereno's Census center point:
| Case type | Courthouse | Distance |
|---|---|---|
| Civil (limited and unlimited), evictions, small claims, probate | Downtown Superior Court (DTS), 191 North First Street, San Jose | about 8.6 miles |
| Family law, juvenile dependency, traffic | Family Justice Center Courthouse (FJCC), 201 North First Street, San Jose | about 8.6 miles |
Both buildings open from 8:00 a.m. to 5:00 p.m. on weekdays. At DTS, the civil line (408) 882-2100, the probate line (408) 882-2654 and the small claims line (408) 882-2352 each answer from 8:30 a.m. to 3:00 p.m., Monday through Thursday, and until noon on Friday. Each division also takes email: sscivilinfo@scscourt.org, ssprobinfo@scscourt.org and sssclaimsinfo@scscourt.org. The DTS drop box is in the lobby for anyone filing civil documents, available whenever the lobby is open, and the court asks filers to follow its posted drop box guidelines. The mailing address for court filings is 191 North First Street, San Jose, CA 95113.
The court's civil updates page adds one change for 2025: since September 22, 2025, non-CEQA writs of mandate are heard in Department 66 at the Family Justice Center, even though they're filed at DTS.
Motions in Monte Sereno civil cases
Santa Clara County is strict about motion dates. Since January 1, 2024, Local Civil Rule 8(B)(2) requires a moving party to reserve a hearing date before filing a pretrial motion in a civil, complex or unlawful detainer case. The court's updates page sets out how:
- Reserve the date online through the court's scheduling system, or by phone at 408-882-2430, Monday through Thursday 8:30 a.m. to 3:00 p.m., and Friday until noon.
- File within 5 business days. If the moving papers aren't filed in that window, the date is released to other cases.
- Expect rejection otherwise. A motion filed without a reserved date is rejected with instructions to get one.
Two kinds of motions are exempt: those in complex departments, and motions that have to be served before they're filed. Once the motion is on file, the papers still need timely service on the other parties. We can file the motion and serve it on the same request; see Santa Clara County court filing.

E-filing: who must and what stays on paper
The court's e-filing page says e-filing is mandatory for attorney-represented parties in civil, family and probate cases, with civil covering complex, unlawful detainer, later civil harassment filings and all limited and unlimited cases. Small claims e-filing is available but optional. Self-represented parties aren't required to e-file.
The page also lists documents the court still takes in hard copy, including:
- Abstracts and writs.
- Family law judgments and defaults.
- Out-of-state commissions, sister-state judgments and the local form for subpoenas in out-of-state actions.
- Certificates of facts about unsatisfied judgments.
The court asks for searchable PDFs, with searchable PDF/A preferred. Documents in complex civil cases have moved to the court's Case Information Portal, where they're free to view for now, though the court says it may charge for access later. Our post on California court e-filing explains how we handle it.
Small claims for Monte Sereno residents
Every Santa Clara County small claims case is filed and heard at DTS. The court's small claims page sets the limits:
- $12,500 for an individual, including a sole proprietor doing business under a fictitious name.
- $6,250 for a corporation, partnership or any business that isn't a sole proprietorship.
- Two a year over $2,500. No one may file more than two claims over $2,500 anywhere in California in a calendar year, though smaller claims are unlimited.
Small claims rules are part of the court's Local Civil Rules, in Rule 19, which covers the proper courthouse, the trial date, service of claims, settlement, dismissal for not appearing and appeals. The court's Small Claims Advisor takes questions through an online contact form, including questions on how to serve the forms.
The person suing can't serve the claim. A friend, a sheriff or a process server can. Send us the claim together with the hearing date the clerk assigned, so the attempts are scheduled well ahead of the service deadline that date sets. See who can serve papers in California.
Family law, probate and the Self-Help Center
Family cases from Monte Sereno go to the Family Justice Center, where the family line, (408) 534-5711, keeps the same phone hours as DTS. The Self-Help Center and Family Law Facilitator's Office there helps people without lawyers with family law, restraining orders, guardianships, conservatorships, name changes and landlord and tenant cases. It answers by phone at 408-882-2926 on Monday, Tuesday and Thursday mornings into early afternoon, with no voicemail. Its LiveChat, offered the same hours, will be suspended effective November 23, 2026. In-person help is limited to emergencies, such as restraining orders and emergency custody requests, at the Restraining Order Help Center at 201 North First Street. Much of its help now comes through online workshops: starting a divorce, legal separation or nullity, preliminary declarations of disclosure, parentage, limited conservatorship, probate guardianship, answering an eviction, and a review for finishing a divorce. A tenant who wants help with an eviction answer has to watch the online eviction workshop first.
Probate matters for Monte Sereno estates are filed at DTS. The court's probate FAQ answers a question families often have: whether someone left a will. Probate Code section 8200(a) requires the original will to be filed with the court in the county where the person lived within 30 days after death. For a Santa Clara County resident, the Records Division at DTS can pull it with the full name and year of death. The same FAQ says adoption files are confidential, available only to the adopting parent or their lawyer, and copied at no charge. For a problem with a conservator, the FAQ directs people to the Court Investigator's Unit at (408) 882-2761.
Divorce and custody papers need personal service by an adult who isn't a party. Send us the hearing date and any safety details, and see our proof of service guide for form FL-115.
Evictions in Monte Sereno
A landlord renting a Monte Sereno home files the unlawful detainer at DTS, and attorneys must e-file it. After service, the tenant's answer is due 10 court days after personal delivery, not counting weekends and court holidays. After substituted service or posting, it's 10 calendar days plus 10 court days from the day after the mailing. Posting requires a court order under CCP § 415.45. The 2027 substituted service changes are explained in our AB 747 guide.
Sending a Monte Sereno request
Include the documents, each person to serve, every address you have and a Letter of Instruction with the best times, a description and any work address. For a business party, send its agent for service from the Secretary of State's bizfile Online; see serving corporations. Get each update by email. If the person has moved, skip tracing can look for a newer address, and document retrieval pulls records from older Santa Clara County files.
