Cupertino sits between Sunnyvale and Saratoga on the west side of Santa Clara County. Its court is the Superior Court of California, County of Santa Clara, which has pulled almost all non-criminal filing into a few buildings in downtown San Jose. For a Cupertino case, that means one filing destination for civil work and a short list of local rules that change what has to be served.
We serve summonses, complaints, subpoenas, family law papers, eviction papers and other legal documents on people and businesses at Cupertino addresses, and we can file in San Jose before service or after.
Where a Cupertino case is filed
The Santa Clara court doesn't split civil filings by region. Its local civil rules name one building for each of the case types people ask about most:
- Limited and unlimited civil: Downtown Superior Court (DTS), 191 North First Street, San Jose. Local civil rule 1.C, effective July 1, 2024, says all of them are filed there. From Cupertino's Census center point it's about 8.5 miles in a straight line.
- Unlawful detainer: DTS as well, under local civil rule 13.C.
- Small claims: filed and heard at DTS under local civil rule 19.A, when the defendant lives in the county, or the contract or the injury is tied to it.
- Probate: DTS, in the Probate Clerk's Office, Room 107.
- Family law: the Family Justice Center Courthouse (FJCC), 201 North First Street, next door to DTS.
Civil hearings happen at DTS and at the Old Courthouse, 161 North First Street, a few doors down. The court's courthouse list shows the Palo Alto Courthouse as a criminal courthouse and the Santa Clara Courthouse as temporarily closed, so neither is an option for a Cupertino civil filing. The court uses 191 North First Street as the mailing address for all of its courthouses.
Counter hours, drop boxes and e-filing
The court posts the same hours for every clerk's office: 8:30 a.m. to 3:00 p.m. Monday through Thursday, and 8:30 a.m. to noon on Friday. The buildings themselves are open 8:00 a.m. to 5:00 p.m. That short Friday matters if a filing has to be in by the end of the week.
There are two drop boxes downtown that matter for Cupertino cases. The DTS drop box is in the lobby and takes civil documents whenever the lobby is open, 8:00 a.m. to 5:00 p.m. on weekdays. The FJCC drop box is inside the building, past the metal detector and before the elevators, with the same hours. The court says there are no drop boxes outside the FJCC.
Most attorneys skip the counter. The court's e-filing page says e-filing is mandatory for every attorney-represented party in civil, family and probate cases, except for listed documents it still takes on paper. Small claims e-filing is available but optional. The court asks for searchable PDFs and prefers searchable PDF/A. Self-represented parties may file and serve on paper unless they agree to e-filing on form EFS-005-CV.
Papers a Cupertino civil defendant must receive
Santa Clara adds one document to the service packet that other counties don't. Under local civil rule 1.D, the person filing a new complaint submits a blank Civil Lawsuit Notice, form CV-5012, and the clerk returns it with the judicial assignment and the date, time and department of the first case management conference. The filer must serve that completed notice on every party named in the complaint, at the same time as the complaint itself.
Two details catch people:
- The clerk only completes the notice if you give one. Include a blank CV-5012 with the filing, then upload the completed copy with the summons and complaint when you send the Service Request.
- The notice has to be current when it's served. If the first case management conference was continued or has already passed, the rule says the serving party fills in the next one. A defendant added later by amendment also gets the notice.
The court's civil division page points to its online Case Information Portal for case and calendar information. Check it for the current conference date before the papers go out, especially when service starts weeks after filing. The same page draws the line between limited and unlimited cases at $35,000, which decides the case type on the cover sheet and the filing fee.
Remote hearings in the Civil Division
Local civil rule 5 governs remote appearances in Cupertino civil cases. Nobody may appear by phone alone unless the court permits it ahead of time, and the request goes in on form CV-5104 at least 15 days before the hearing. Remote appearances otherwise have to be by video, with the person's name and the party they represent shown on screen. Participants are told to keep the camera off and the microphone muted until the case is called.
None of that changes service, but it does affect timing. A hearing date that seems far off can still be close to the 15-day mark for a phone request, so if the papers need to be served before a hearing, send the request early.
Evictions in Cupertino
Every Cupertino unlawful detainer is filed at DTS and assigned to the Unlawful Detainer Department chosen by the Presiding Judge, according to rule 13. Jury trials in those cases can be heard in any available department in the building.
How fast the tenant must respond depends on the service method. The California Courts self-help guide allows 10 court days after personal service, without counting weekends or court holidays. When the summons is left with another adult at the home or posted, and a copy mailed, the tenant gets 10 calendar days from the mailing and then 10 court days. Write the method clearly on the proof of service so the default date can be calculated.
For an apartment complex, give us the building and unit, the gate or lobby entry, and every adult on the lease. For a room rented in a single-family home, describe which entrance the tenant uses.

Small claims for Cupertino residents and businesses
The court's small claims page sets the limits at $12,500 for an individual or sole proprietor and $6,250 for a corporation, partnership or other business entity. No one may file more than two claims for over $2,500 anywhere in California in one calendar year. Attorneys can't appear for a party at the hearing.
Free help comes from the court's Small Claims Advisor, by phone at (408) 882-2929 during live hours on Tuesdays from 2:00 to 4:00 p.m., or through a web form that gets an email reply. The plaintiff can't serve the claim personally, so plan for a server, and tell us the hearing date when you send the claim.
Family law and the Self-Help Center
Divorce, custody, support and domestic violence cases from Cupertino are filed at the FJCC, which also houses the court's Self-Help Center and Restraining Order Help Center. The Self-Help Center helps people without an attorney with family law, restraining orders, guardianship, conservatorship, name changes and landlord-tenant cases. Its phone line, 408-882-2926, is answered Mondays, Tuesdays and Thursdays from 8:30 a.m. to 1:30 p.m. The court says its LiveChat service will be suspended effective Monday, November 23, 2026.
In-person help at the FJCC is limited to emergencies. The Self-Help Center page lists emergency custody and visitation requests and emergency guardianships among the issues handled at the Restraining Order Help Center, 201 North First Street, during its posted hours. Everything else goes through the phone line, email or online workshops, including the eviction workshop tenants must view before getting help with answer forms.
The petitioner can't serve the other party. An adult who isn't part of the case does it, and the proof for a family law summons is usually form FL-115.
Probate for Cupertino estates
Probate cases are heard at DTS, and the Probate Clerk's Office is in Room 107. The court's probate page describes examiners who review filings before hearings, and a probate staff attorney who reviews urgent petitions and hearings on less than 15 days' notice. Appointments with the staff attorney go through (408) 882-2100. The examiners sometimes pre-approve a petition without a hearing, and the court's Probate Advance Case Status Reports page shows whether that happened, so check it before sending anyone to a hearing. Probate notices and citations to heirs at Cupertino addresses can go on the same request as a filing at Room 107.
Cupertino's ZIP Code and the hills
Cupertino has one Census ZIP Code area, 95014, and it covers much more than the city. The Census Bureau's 2020 ZCTA to place relationship file puts only about 44% of its land inside Cupertino, with tiny slivers in San Jose and Sunnyvale. The other 55% is in no city at all, and the Census internal point for the ZIP Code area lies about 2 miles west of the city's own, so most of that county land is on the western side.
For service, that means a "Cupertino" address may be a home on unincorporated county land, sometimes reached by a narrow road or a shared private drive. A cross street, a description of the driveway, a gate code you can share or a photo of the house saves a trip. Remote areas are subject to different timelines, and an address far from the nearest through road can take longer to reach.
Serving at Cupertino offices and campuses
People can be served at work, but a large office campus may have lobbies, badge readers and security desks, and the person at the front usually can't accept papers for someone else. Give us the building, the department or team, the person's role and their usual hours, and a home address as a backup.
When the defendant is the company, don't send the server to a reception desk. Look up the corporation or LLC's agent for service of process on bizfile Online and send us that name and address. Large companies often use a commercial registered agent, and our pages on CSC Lawyers Incorporating Service and CT Corporation explain how service on those two works. Serving corporations covers the rest.
Sending a Cupertino Service Request
- Upload up to 5 PDFs on the Service Request: the summons, complaint, the completed Civil Lawsuit Notice and anything else the case requires.
- Name the person or business exactly as the papers do.
- List every address, with unit, gate and building details.
- Choose Rush or Standard, and add a San Jose filing if you need one.
