Santa Clara sits between San Jose and Sunnyvale in the middle of Silicon Valley. It had 127,647 residents at the 2020 Census, and the Census Bureau puts it at 133,446 for July 1, 2025. We serve summonses, complaints, subpoenas, family law papers and landlord-tenant documents on people and companies anywhere inside the city limits.

Santa Clara the city and Santa Clara the county

The shared name causes mix-ups. The Superior Court of California, County of Santa Clara is one court for the whole county, from Palo Alto to Gilroy. Its civil, probate and small claims courthouse is on North First Street in downtown San Jose, not in the city of Santa Clara.

There is a Santa Clara Courthouse, but the court's list of locations shows it as temporarily closed, with no address, phone or services posted. Older letters and online directories may still point people there. Send the filing to San Jose instead.

Every Santa Clara County courthouse uses one mailing address: 191 North First Street, San Jose, CA 95113. That holds even for the criminal courthouses in Palo Alto and Morgan Hill.

Filing a case that involves a Santa Clara party

The county's local rules send nearly every non-criminal filing to two buildings on the same street in San Jose. The straight-line distance from central Santa Clara to either one is about 4.5 miles.

Some civil hearings happen next door at the Old Courthouse, 161 North First Street (Departments 17 to 22), but filing stays at Downtown Superior Court.

Clerk's offices and phones run Monday through Thursday, 8:30 a.m. to 3:00 p.m., and Friday, 8:30 a.m. to noon, though the buildings stay open until 5:00 p.m. Plan Friday deadlines around the noon close.

Our Santa Clara County court filing page explains how we handle counter filings and e-filings for this court, and how the conformed copies come back to you.

Getting a Santa Clara Service Request right the first time

A complete request saves days. Here is what we look for when a Santa Clara address comes in:

  1. The papers as filed. The endorsed summons, complaint and attachments, up to 5 PDFs. For small claims, include the court's notice to litigants (see below).
  2. The exact name. A person's full legal name and other names they use, or a company's name exactly as the Secretary of State lists it.
  3. Every address, ranked. Home, then workplace, each with its unit or suite number.
  4. A Letter of Instruction. Shift hours, a car, a photo, a gate or lobby code, a hearing date.
  5. Rush or Standard, plus a Billing Reference if your office uses one.

ZIP Codes that cross the Santa Clara city line

Four Census ZIP Code areas are mostly inside Santa Clara: 95050, 95051, 95053 and 95054. The fit isn't perfect, and that matters when someone gives you only a ZIP Code or a mailing city.

  • 95050 covers central Santa Clara, but a small part of it lies inside San Jose.
  • 95051 is the west side of the city. Thin strips of it fall in Cupertino, San Jose and Sunnyvale, plus a sliver of unincorporated land.
  • 95054 is the north end, toward the bay. Pieces of it are in San Jose and Sunnyvale.
  • 95053 is a tiny ZIP area, about 0.15 square miles, and all of it is inside Santa Clara. It's the ZIP Code Santa Clara University uses for its campus at 500 El Camino Real.

A small piece of 95110 also falls inside the city. None of this changes the court, but it changes how a server finds the door, so give the full street address. Census ZIP Code areas approximate postal ZIP Codes; figures come from the 2020 ZCTA to place relationship file.

Papers to serve in Santa Clara?

Serving someone at Santa Clara University

University addresses come up in Santa Clara more than in most cities: a student in a landlord dispute, a staff member subpoenaed as a witness. The campus has its own ZIP Code, 95053, and its official address is 500 El Camino Real.

Residence halls and many campus buildings control who can walk in, so a room number alone often isn't enough. An off-campus address, a class or work schedule, a recent photo and the staff member's department help most. If campus attempts fail, the Letter of Instruction tells us what to try next.

Small claims rules a Santa Clara plaintiff should know

Santa Clara County's small claims cases are filed and heard only at Downtown Superior Court, under Local Civil Rule 19.A. That rule applies when the defendant lives in the county, the contract was made or performed here, or the injury or damage happened here.

A few more local details from Rule 19 and the court's pages:

  • Serve the local notice too. Rule 19.D(1) says the plaintiff must serve the Notice to Small Claims Litigants (form SC-8006) with the claim.
  • Certified mail by the clerk is an option. Rule 19.D(2) lets either side pay the clerk to mail the claim. Whether that service was proper is for the judge to decide.
  • Out of time to serve? Under Rule 19.D(3), a plaintiff who can't serve in time can ask for a later hearing date at the clerk's office at least one court day before the hearing.
  • Claim limit. An individual can sue for up to $12,500, according to the court's small claims page.
  • Free advice. The Small Claims Advisor takes calls at (408) 882-2929 on Tuesdays from 2 to 4 p.m., or by web form.

Personal service is the other route. We serve the claim and the notice together and return the proof for filing before the hearing.

Companies with a Santa Clara address

Santa Clara has many corporate campuses, and the lobby is rarely the right place for a summons. The usual recipient is the agent for service of process on file with the Secretary of State. Search bizfile Online and send us the agent's name and address exactly as listed.

When a company names a commercial registered agent, we serve that agent's office, wherever it is. Two common ones are CSC Lawyers Incorporating Service and CT Corporation. For officers, out-of-state entities and other options, see serving corporations in California.

What AB 747 means for Santa Clara service in 2027

From January 1, 2027, the diligence behind a substituted service is shown by good-faith tries at personal delivery on at least 3 occasions, on 3 different days at 3 different times (CCP § 415.20(b)(2)). Each attempt also needs a photo with an automatic date, time and GPS stamp on the proof of service.

In Santa Clara, that changes the planning more than the travel. Someone who leaves early and gets home late may need a morning, an evening and a weekend try. A home and a work address keep the three attempts from stacking up at one door. Our AB 747 guide explains the full set of changes, and proof of service in California covers what the server's declaration has to show. This is general information, not legal advice.

When the address is wrong or old

If the attempt notes show the person moved, ask about skip tracing. We research a newer address, and with your approval the papers go back out. See how to find a defendant in California.

Santa Clara process server questions

Not listed here? Call 855-582-5776 during business hours, Mon–Fri 8:30 a.m.–5 p.m.

Is there a courthouse in the city of Santa Clara where I can file?

Not right now. The court's courthouse list shows the Santa Clara Courthouse as temporarily closed, with no services listed. Civil, unlawful detainer, small claims and probate papers for a Santa Clara case go to Downtown Superior Court, 191 North First Street in San Jose, and family law papers go to 201 North First Street. Source: santaclara.courts.ca.gov, checked October 2026.

My caption says County of Santa Clara. Does that mean the case is in the city?

No. Superior Court of California, County of Santa Clara is the countywide trial court, and its civil courthouses are in downtown San Jose. A defendant in Santa Clara, Gilroy or Sunnyvale is sued in that same court.

Can a self-represented plaintiff in Santa Clara still file on paper?

Yes. The court requires e-filing for attorney-represented parties in civil, family and probate cases and says self-represented parties are not required to e-file. Paper filings can go to the Downtown Superior Court clerk's office or the lobby drop box, which is open 8 a.m. to 5 p.m. on weekdays. Source: santaclara.courts.ca.gov, checked October 2026.

What extra paper has to go with a Santa Clara County small claims claim?

Local Civil Rule 19.D(1) says the plaintiff must serve the Notice to Small Claims Litigants (local form SC-8006) along with the Plaintiff's Claim and Order to Go to Small Claims Court. Upload both PDFs with your Service Request so they are served together. Source: Santa Clara County Local Rules, effective July 1, 2026, checked October 2026.

Can you serve a student or employee at Santa Clara University?

We can attempt service at any address you give us, including a campus address in ZIP Code 95053. Campus buildings and residence halls usually limit who can walk in, so an off-campus home address, a class or work schedule and a photo give the server better chances. We make no guarantees for service.
