Milpitas is an incorporated city at the northern edge of Santa Clara County, with about 13.5 square miles of land and Fremont, in Alameda County, on its northern side. The 2020 Census counted 80,273 residents, and the Census Bureau estimated 78,596 for July 2025. Valpro Attorney Services serves summonses, complaints, subpoenas, motion papers, restraining orders, family law papers and eviction documents on people and businesses in Milpitas, and files Milpitas cases in San Jose.
We handle Milpitas requests from our Sacramento office, about 84 miles away. Papers come in online, the attempts happen at the Milpitas address, and every update comes by email.
One ZIP Code area, two kinds of land
Milpitas uses a single ZIP Code area, 95035. The Census Bureau's 2020 ZCTA-to-place file shows that it covers much more than the city:
- About 60% of the land in 95035 is inside Milpitas.
- About 40% is outside any city or census-designated place. That land is unincorporated and governed by the County of Santa Clara.
- A sliver falls inside San Jose.
From the city's side, about 99.8% of Milpitas is in 95035, and the remaining 0.2% sits in 95134, a San Jose ZIP Code area. So a "Milpitas, CA 95035" address is almost always in Santa Clara County, but it isn't always inside the city.
The county line deserves a second look. Milpitas borders Fremont, and Fremont cases belong to the Alameda County Superior Court, a separate court with its own courthouses and rules. If a party lives on the Fremont side, or a contract was signed there, confirm venue with your attorney before filing. We serve on both sides of the line, and our Alameda County page covers that side.
Courthouses for Milpitas cases
There's no courthouse in Milpitas. The Santa Clara County court's Local Civil Rules send Milpitas matters to two buildings on North First Street in downtown San Jose.
| Milpitas matter | Courthouse | Straight-line miles |
|---|---|---|
| Limited and unlimited civil (Rule 1.C) | Downtown Superior Court, 191 N. First St. | 6.6 |
| Unlawful detainer (Rule 13.C) | Downtown Superior Court | 6.6 |
| Small claims (Rule 19.A) | Downtown Superior Court | 6.6 |
| Probate, Room 107 | Downtown Superior Court | 6.6 |
| Family law | Family Justice Center Courthouse, 201 N. First St. | 6.5 |
Distances run from the Census Bureau's internal point for Milpitas to the coordinates on each court page. Court facts were checked on santaclara.courts.ca.gov in October 2026.
Attorneys must e-file in civil, family and probate cases. A few documents still go on paper, including writs, abstracts, sister-state judgments and the court's local form for subpoenas in out-of-state actions. Our Santa Clara County court filing service can take a paper filing to the counter or e-file it, and then serve the endorsed copies.
Serving the City of Milpitas
When the city is a party, the summons goes to City Hall at 455 East Calaveras Boulevard, Milpitas, CA 95035. The city's City Clerk page lists the office there and describes the City Clerk as the city's records manager and the Clerk of the City Council. The same page says the City Clerk is also secretary to the Public Financing Authority, the Milpitas Municipal Financing Authority and the Housing Authority.
That matters because each of those bodies is its own public entity. CCP § 416.50 lets a summons on a public entity be delivered to its clerk, secretary, president, presiding officer or other head of its governing body. Name the right entity in the caption, and tell us which one each set of papers is for.
Three cautions for these cases:
- The claim usually comes before the lawsuit. For money damages, a written claim to the public entity normally has to be filed and decided before suit. Your attorney handles that step.
- Subpoenas for city records are served like any other subpoena, but a public records request is a separate process and serves nothing.
- Check department names. If a draft caption says "Milpitas Police" or "Milpitas Fire," ask your attorney whether the defendant should be the City of Milpitas.
Restraining orders for Milpitas employers and residents
Local Civil Rule 7.B covers requests for civil harassment, elder abuse, workplace violence, private postsecondary school violence and transitional housing misconduct restraining orders. Each one needs form CV-5014, the court's Declaration in Support of Ex Parte Application for Civil Restraining Orders, and can be e-filed or filed in person during clerk hours.
A workplace violence order is requested by the employer on behalf of an employee (CCP § 527.8), and a civil harassment order by the person harassed (CCP § 527.6). Either way, the person to be restrained is served personally with the petition, the notice of hearing and any temporary order, and the server signs a proof of personal service: form WV-200 or CH-200. The petitioner can't serve it.
For a Milpitas request, send the filed papers, the hearing date, a photo of the person to be restrained, the home address and, for workplace cases, the person's shift times if known. If the person is likely to avoid service, say so, and call 855-582-5776 before you choose Rush.
Papers to serve in Milpitas?
Motion papers and trial deadlines
Santa Clara County's civil rules put tight clocks on motion practice, and service is part of every one:
- Reserving a date. Under Rule 8.A(2), the moving party meets and confers on hearing dates and reserves one through the court's website. A reserved date is forfeited if the motion isn't filed within five court days.
- Notice period. CCP § 1005(b) sets the general notice period at 16 court days before the hearing. Service by mail within California adds five calendar days, and overnight delivery adds two. Personal delivery adds nothing.
- Tentative rulings. Rule 8.D: posted by 2:00 p.m., and no later than 3:00 p.m., the court day before. A party contesting one notifies the other side and the court by 4:00 p.m.
- Trial papers. Rule 9.C has in limine motions, exhibit and witness lists, jury instructions, trial briefs and similar items filed, served on all parties and delivered as courtesy copies to the trial department by noon on the Friday before trial.
A server can hand motion papers to a self-represented Milpitas party or to opposing counsel's office the same week the motion is filed. A court runner can deliver the courtesy copies on the same request.
Milpitas evictions
Every unlawful detainer in the county is filed at the Downtown Superior Court and assigned to its eviction department (Rules 13.C and 13.D). Rule 13.F lets any party who has appeared file form UD-150 to set the case for trial, and the court may dismiss a case on its own if no one files that request within 60 days of the complaint. If the tenant moves out before trial, Rule 13.G keeps it an eviction case unless a party moves to convert it to an ordinary civil action.
Send the summons, the complaint and the notice that started the case, the names of all adult occupants, and building and gate details for apartment complexes. A tenant served personally has 10 court days to respond, per the California courts' self-help page. In 2027, AB 747 adds a photo requirement to eviction proofs of service, described below.
Divorce and custody papers for Milpitas families
Family law cases from Milpitas are filed at the Family Justice Center Courthouse, 201 North First Street, which the court lists for family law, juvenile dependency, traffic and drug court. The court's Self-Help Center is in the same building. A parent with a child between 2 and 12 can use the Children's Waiting Room on the first floor while handling court business there. Family clerk questions go to (408) 534-5711 or ssfamilyinfo@scscourt.org, during the same 3:00 p.m. weekday and Friday-noon phone hours as the civil desk.
After filing, the petition and summons go to the other spouse or parent wherever they're living now. The family law summons gives the respondent 30 days to file a response, counted from service. Send the filed petition, the summons, a blank response form and any order to show cause or request for order with its hearing date.
Milpitas apartment complexes
When a Milpitas address is a unit in a larger complex, each detail below spares the server a wasted trip:
- Building and unit number, not just the street address of the complex.
- Gate access: a call-box code, a resident directory entry, or the hours the pedestrian gate is unlocked.
- Parking: where visitors can stop without being towed.
- The leasing office: whether it's open on weekends, if you want it noted. Handing papers to leasing staff isn't service on a tenant.
- Other adults in the unit, with names if you have them.
The 2027 service rules in Milpitas
From January 1, 2027, AB 747 defines reasonable diligence for substituted service. A party shows it by attempting personal delivery in good faith on at least three occasions, on three different days, at three different times (CCP § 415.20(b)(2)). For an unlawful detainer summons, the proof of service is to include at least one photograph of the site, carrying a readable stamp with the date, time and GPS coordinates, if the server can take it without compromising safety. Where there's no GPS or cellular signal, the server gives a detailed statement instead.
For an apartment, the photo shows the unit door or the building entry the server could reach. Our AB 747 guide covers the rest of the changes. We make no guarantees for service.
Small claims from Milpitas
A Milpitas small claims case is filed and heard at the Downtown Superior Court (Rule 19.A and 19.C(2)). Individuals and sole proprietors can claim up to $12,500, and other businesses up to $6,250, according to the court's small claims page. The plaintiff serves form SC-8006 along with the claim. Personal service by a non-party adult comes back with a signed proof, which avoids waiting to see whether a certified-mail receipt was signed.
Serving a business in Milpitas
Look up the company's agent for service of process on the Secretary of State's bizfile Online, and send us the agent's name and address exactly as listed. Large companies often use a commercial agent such as CSC or CT Corporation, and service is made at the agent's office. For a subpoena to an employee, name the person, the employer and the work address, plus any lobby or badge-desk details you know. Our serving corporations page explains officers and out-of-state entities, and skip tracing can find a newer address.
