In San Luis Obispo County, a mountain pass draws the court map. The Cuesta Grade on U.S. 101 splits North County from the rest, and the local rules use it to decide which courthouse hears a case. We serve papers on both sides of the grade and file at either branch or electronically. North or south of the Cuesta Grade
Local Rule 9.27 lets a civil case be filed at any court location except the Juvenile Services Center and the Veteran's Hall. Assignment is what follows the geography:
- San Luis Obispo courthouse, 1050 Monterey Street: San Luis Obispo, Avila Beach, Cayucos, Los Osos, Morro Bay, Grover Beach, Arroyo Grande, Nipomo, Oceano, Pismo Beach and unincorporated areas south of the grade.
- Paso Robles Branch, 901 Park Street: Paso Robles, Atascadero, Cambria, Santa Margarita, Templeton and unincorporated areas north of the grade.
The first pleading has to include an allegation that establishes venue. Unlimited civil cases are assigned only to those two locations.
Small claims works a little differently. Under Local Rule 9.28, the case is filed and heard at the location tied to the defendant's residence or principal place of business, using the same north-south split. A claim against a Templeton business goes to Paso Robles even if the plaintiff lives in Pismo Beach.
Probate is the exception to the split. The court says all probate matters are filed and heard at the Civil & Family Law Branch in San Luis Obispo.
Short counter hours, long e-filing hours
The court's site carries a service-level notice: after budget cuts, counters and phones run mornings only. The Room 220 counter in San Luis Obispo is open 8:30 a.m. to noon, Monday through Thursday. Paso Robles opens its counter only on Wednesdays and Fridays, 8:30 a.m. to noon. Phones at (805) 706-3600 are answered 8:30 a.m. to noon on weekdays.
E-filing fills the gap. It's been mandatory since January 1, 2017 for every civil case type: unlimited and limited civil, small claims, probate and guardianships, family law, family support, adoption and mental health. Self-represented parties are exempt but encouraged to join in. Civil fax filings are no longer accepted. E-filings received before 11:59 p.m. on a court day are filed that day.
The Paso Robles counter is closed Mondays, Tuesdays and Thursdays, so a North County deadline on those days means e-filing. We handle both routes through San Luis Obispo County court filing. General information, not legal advice.
Small claims: the certified mail rule
Local Rule 9.28 has a cost rule that matters for service. If the plaintiff didn't first try service by certified mail without success, whether the cost of personal service can be recovered is up to the judicial officer. Continuance requests have to be in writing at least 10 calendar days before trial.
Personal service still gives you a signed proof of service with names, times and a description. If you want papers served in person, we serve them and send back a proof of service for filing. The county's free Small Claims Advisor, through the San Luis Obispo Legal Assistance Foundation, holds office hours in San Luis Obispo on Tuesdays and Wednesdays and in Paso Robles on Thursdays.
The Sheriff's Civil Division
The San Luis Obispo County Sheriff's Civil Division also serves civil process. Its FAQ asks for written instructions signed by the plaintiff or attorney of record, with the defendant's name exactly as it appears on the court papers. It usually starts attempts the business day after it receives papers. It sends you the proof of service, and filing it with the court is your job. Any adult who isn't a party may serve instead; see who can serve papers in California.
Coast, wine country and open range
San Luis Obispo County had 282,424 residents in the 2020 Census. The largest cities are San Luis Obispo (47,063), Paso Robles (31,490) and Atascadero (29,773). Paso Robles is the closest of the county's cities to our Sacramento office at about 211 miles straight-line, and Arroyo Grande the farthest at about 246.
Many county addresses are outside any city. Nipomo, Los Osos, Templeton, Cambria, Oceano, Avila Beach, Cayucos and Santa Margarita are all unincorporated communities named in the court's venue rules. Treat those addresses the same as city addresses: the street, the unit and the ZIP the person uses.
Then there's the back country. East of the Salinas River valley, the county opens into ranch land around Shandon, Creston, California Valley and the Carrizo Plain. To the north, the coast past Cambria and San Simeon runs toward Big Sur on Highway 1. Remote areas are subject to different timelines. Vineyard, winery and ranch parcels often have a gate well away from the house, so describe it.
