Morro Bay cases belong in San Luis Obispo
San Luis Obispo County Superior Court sorts cases between two courthouses by geography, and its local rules name Morro Bay in the San Luis Obispo group every time:
| Morro Bay matter | Rule | Where it's assigned |
|---|---|---|
| Civil, limited and unlimited | Local Rule 9.27(b) | San Luis Obispo Courthouse |
| Small claims | Local Rule 9.28(a)(1) | San Luis Obispo, by the defendant's residence or business |
| Family law | Local Rule 19.04(a)(1) | San Luis Obispo Branch, by the petitioner's residence |
| Probate | Probate division page | All probate is filed and heard in San Luis Obispo |
The clerk's office is at the Civil & Family Law Branch, 1050 Monterey Street, Room 220, San Luis Obispo, CA 93408. It's about 13 miles from central Morro Bay in a straight line. The Paso Robles Branch, the county's North County courthouse, is about 20 miles away.
Rule 9.27 also lets a civil case be filed at any court location except the Juvenile Services Center and the Veteran's Hall, as long as it's assigned to the right courthouse. The court's civil and small claims pages, though, list counters only in San Luis Obispo and Paso Robles, and the Veteran's Memorial Branch is marked temporarily closed.

Put the venue in the first pleading
Rule 9.27(d) says the first pleading in a civil action must contain an allegation that establishes proper venue. For a Morro Bay case, that means the complaint should show why it belongs at the San Luis Obispo Courthouse, such as where the defendant lives or where the dispute arose. Rule 9.27(f) lets the court move a case for good cause or on its own motion.
Family law has its own form. Under Rule 19.04, which took effect July 1, 2026, the party filing the first pleading includes Local Form FL013, Statement of Venue. A Morro Bay petitioner's case is assigned to the San Luis Obispo Branch. If the petitioner lives outside the county, venue follows the respondent's residence instead.
Before we submit a Morro Bay filing for you, make sure the venue allegation or FL013 is in the packet. Our San Luis Obispo County court filings page lists what we need.
Where the coast splits between two courthouses
Highway 1 runs through several coastal communities, and they don't all go to the same courthouse. The rules draw the line at the Cuesta Grade, with an extra reference to the Ontario Grade in the civil rule:
| Coastal community | Courthouse under Rules 9.27, 9.28 and 19.04 |
|---|---|
| Los Osos | San Luis Obispo |
| Morro Bay | San Luis Obispo |
| Cayucos | San Luis Obispo |
| Cambria | Paso Robles Branch |
So a dispute between a Morro Bay landlord and a tenant who has moved up the coast to Cambria can raise a venue question for small claims, where the rule looks at where the defendant lives. That's a question for you or your attorney. We serve in both places.
Counter mornings only
The San Luis Obispo civil walk-up window is open Monday through Thursday, 8:30 a.m. to 12:00 p.m. There's no afternoon window and no Friday counter there. Phones at (805) 706-3600 are answered Monday through Friday, also 8:30 a.m. to noon.
The Paso Robles Branch, 901 Park Street, keeps counter hours on Wednesday and Friday mornings, 8:30 a.m. to noon. For a Morro Bay filing due on a Friday, that's the only open counter in the county.
E-filing avoids most of this. The court made it mandatory on January 1, 2017 for civil case types including unlimited, limited, small claims, probate and family law. Self-represented parties are exempt but encouraged to use it. E-filings received before 11:59 p.m. on a court day are filed that day. Civil fax filings are no longer accepted. Our post on court e-filing in California has the general picture.
Small claims involving Morro Bay
The court's small claims page sets the limits at $12,500, or $6,250 for a business. A claim against a Morro Bay defendant is filed and heard in San Luis Obispo under Rule 9.28(a)(1). Rule 9.28(b) adds a point about costs: if the plaintiff hasn't first tried service by certified mail without success, the cost of personal service is left to the judicial officer's discretion.
Free help is available from the Small Claims Advisor, run through the San Luis Obispo Legal Assistance Foundation. The court lists its hours at the San Luis Obispo courthouse as Tuesday and Wednesday, 9:00 a.m. to 1:00 p.m., with Thursday hours at Paso Robles. Its list of services includes guidance on serving court documents.
When the claim is filed, send it with the trial date and the defendant's address. A request to continue the trial has to be in writing at least 10 calendar days before trial under Rule 9.28(c), so don't leave service to the last week.

Estates and conservatorships from Morro Bay
Every probate matter in the county is filed and heard at the Civil & Family Law Branch in San Luis Obispo. The court's probate page answers the timing questions most families ask:
- First hearing. New cases are usually set 4 to 5 weeks out, to allow publication of the Notice of Probate.
- Probate notes. The court aims to post the first version within about a week of the hearing and update it the day before.
- Other requests are usually set 10 to 12 weeks from filing.
- Remote appearance is allowed in most uncontested probate matters under California Rules of Court, rule 3.670, unless the court orders a personal appearance.
- Certified copies cost $40 plus 50 cents a page, issued after the court orders them.
- Lodging an original will costs $50, and the court accepts a will only after the person has died.
Heirs and interested people who need formal notice can be served by us. List each one with the address and the hearing date.
Serving someone who lives on a boat
Morro Bay is a working harbor, and some residents live aboard. The city's Harbor Department manages 50 city slips and about 125 moorings, roughly 50 of them privately owned. Under Chapter 15.40 of the Municipal Code, Vessel Habitation, liveaboards need a permit, with a cap of 50. The liveaboard must be the vessel's registered or documented owner, and the boat must have a permanent docking location in Morro Bay. The city says no liveaboards are permitted at the City T-Piers.
For a liveaboard or a boat owner, the details make the difference:
- The vessel's name and its registration or documentation number.
- The slip or mooring, and the marina or dock if it isn't a city slip.
- A shore address, such as a mailing address, a car or a workplace.
- When the person is usually ashore, if you know.
A boat on a mooring sits out in the water, not at a dock, so a shore location is often the practical place to make contact. The Harbor Department office is at 1275 Embarcadero, open weekdays from 8:00 a.m. to 5:00 p.m.
ZIP Code 93442 reaches past the city
The Census matches one ZIP Code area, 93442, to Morro Bay. It covers about 44.5 square miles of land, much more than the city:
- Morro Bay city is about 11% of that land, and about 95% of the city's own land is inside it.
- Cayucos, an unincorporated Census-designated place to the north, is about 1.4%.
- About 87% lies outside any city or Census-designated place.
These figures come from the Census Bureau's 2020 ZCTA to place relationship file. ZIP Code areas approximate postal ZIP Codes. Cayucos and Morro Bay share the San Luis Obispo venue, so the courthouse doesn't change. The address and directions do. Remote areas are subject to different timelines, and a rural road outside town needs a map pin, a gate code and a description of the house.
Serving a Morro Bay business or the city
For a company, serve the agent for service of process shown on the Secretary of State's bizfile Online. A waterfront shop or restaurant employee usually can't accept for the business. Many companies name a commercial agent such as CSC, and we serve that agent wherever it is. Our serving corporations page explains the options.
A suit against the City of Morro Bay itself is served on the city's clerk or the head of its governing body under Code of Civil Procedure section 416.50. City Hall is at 595 Harbor Street. Most damage claims against a public entity need a government claim first, so check with your attorney.
