San Clemente is a long way from the Orange County courthouses that hear its cases. Civil suits, evictions and small claims are filed at the Central Justice Center in Santa Ana, about 26 miles north. Family law goes to Orange and probate to Costa Mesa, both farther than 24 miles. The nearest building, the Harbor Justice Center in Newport Beach, takes only criminal and traffic matters. There's also a county question: most of the land in ZIP Code 92672 is in San Diego County, not Orange County.
We serve summonses, subpoenas and every other legal document at San Clemente homes and businesses, and we file the case for you in Santa Ana, Orange or Costa Mesa. Send a Service Request or email the papers to Service@ValproAttorneyServices.com.
San Clemente's justice centers by case type
Orange County assigns cases to buildings by city, through the Court Designation List the presiding judge issued under Local Rule 365, effective June 30, 2025. This is the San Clemente row, with straight-line distances from the city's Census center point:
| San Clemente case | Justice center | Distance |
|---|---|---|
| Limited and unlimited civil | Central Justice Center, 700 Civic Center Drive West, Santa Ana | 25.7 mi |
| Small claims | Central Justice Center | 25.7 mi |
| Unlawful detainer and civil harassment | Central Justice Center | 25.7 mi |
| Probate, mental health, elder abuse orders | Costa Mesa Justice Complex, 3390 Harbor Blvd. | 24.4 mi |
| Family law, domestic violence, juvenile | Lamoreaux Justice Center, 341 The City Drive South, Orange | 28.1 mi |
| Criminal and traffic | Harbor Justice Center, 4601 Jamboree Road, Newport Beach | 20.4 mi |
The list adds that civil and probate actions must be e-filed. Complex civil cases are heard at the Civil Complex Center, 751 West Santa Ana Boulevard, in Santa Ana.
The Harbor Justice Center handles criminal and traffic
San Clemente's closest courthouse is the Harbor Justice Center on Jamboree Road. The court's page for the building says it handles traffic, minor offenses and criminal matters. Its list of cities served runs from Aliso Viejo to Trabuco Canyon and includes San Clemente, San Juan Capistrano, Dana Point and Capistrano Beach, plus the surrounding unincorporated areas.
None of that is civil filing. A San Clemente complaint, eviction or small claim is filed in Santa Ana. The Harbor building can still appear on papers that need serving, such as a subpoena for a witness in a criminal case. The page lists traffic hours of 8:00 a.m. to 4:00 p.m. on weekdays and describes the building as a full security facility, where every visitor passes through weapons screening and hand-carried items are x-rayed.
If you send us a criminal subpoena for a San Clemente witness, include the department, the appearance date and any instructions from the issuing attorney's office.
92672 and the San Diego County line
San Clemente has two ZIP Codes, and the Census Bureau's 2020 relationship files show they behave very differently:
- 92673 is about 96.5% San Clemente, with about 2.6% in San Juan Capistrano. All of it is in Orange County. It holds about 54% of the city's land.
- 92672 holds the other 46% of the city's land. But San Clemente makes up only about 24% of the ZIP's own land area. The other 76% lies in San Diego County.
So "San Clemente, CA 92672" usually means an Orange County address, but not always. A property or a defendant on the San Diego County side falls outside the Orange County court's designation list, which covers Orange County cities. Before filing a case whose venue depends on where a property sits, as an eviction's does, confirm which county the parcel is in. Our San Diego County page covers that side of the line.
Service doesn't change: the server goes to the street address you give. The out-of-county question does affect small claims deadlines, covered below.
Filing a San Clemente case in Santa Ana
The court's civil filing page draws the line between limited and unlimited cases at $35,000. A dispute at or under that figure is limited; anything larger, or a case that doesn't ask for money, is unlimited. Both kinds are filed at the Central Justice Center.
Under Local Rule 352 and the state e-filing rules, represented parties must e-file in limited, unlimited and complex civil cases unless the court excuses them. Self-represented filers may e-file or bring papers to the Civil Clerk's Division on the Central Justice Center's first floor, Monday through Friday, 8 a.m. to 4 p.m. A party with a fee waiver who files electronically doesn't pay the electronic filing fees.
For a San Clemente filer, that distance makes e-filing the practical choice. We file by eFiling or at the counter, as the case allows, and move the same request to service once the summons issues. Our Orange County court filing page explains how.
Papers to serve in San Clemente?
Small claims from San Clemente
All Orange County small claims filings are processed at the Central Justice Center, and San Clemente trials are heard there. The court's small claims guide ties the service deadline to the method used. Personal service must be done at least 15 days before the court date, or 20 days when the defendant is outside the county. Substituted service, where the papers are left with a third party and mailed, needs 25 days, or 30 when the defendant is outside the county.
A defendant on the San Diego County side of 92672 is outside Orange County, so use the longer deadlines. The guide also says a defendant generally has to be served in California, with two exceptions: suits over California property owned by someone who lives out of state, and California car accidents involving an out-of-state driver or owner.
The court's self-help page sets the limits: up to $12,500 for an individual or sole proprietor, and up to $6,250 for a corporation, partnership or other entity. Only two claims over $2,500 may be filed in a calendar year. Each person being sued has to be served separately: the guide's example is a car accident claim against both the owner and the driver of the other car, where both must receive the papers. The person suing can't deliver the claim, and the guide calls clerk service by certified mail the least dependable method, since the defendant can refuse it.
Evictions for San Clemente rentals
A San Clemente unlawful detainer is filed at the Central Justice Center, either at the counter or by e-filing. For a self-represented landlord without a computer, the guide points to public computers at most public libraries and at the Orange County Public Law Library. The court's landlord guide lists the starting papers as the summons, the complaint and the civil case cover sheet, with a filing fee that depends on whether the amount claimed is above or below $35,000. A landlord who can't afford the fee can ask for a waiver.
Service follows the usual order. Personal service is complete on the day of delivery. If that fails after diligent tries, substituted service on an adult in charge at the home, followed by mailing, is complete 10 days after the mailing. If both fail, the landlord may ask the court for permission to serve by posting and mailing.
The Judicial Council's eviction guide then sets the tenant's response time: 10 court days after personal service, skipping weekends and court holidays, or 10 calendar days plus 10 court days after the mailing when the papers were left with someone else or posted. If unnamed occupants may live in the unit, ask your attorney about a prejudgment claim of right to possession, which the Orange County guide says only a registered process server or the Sheriff may serve. The guide explains the tradeoff. Skip it, and anyone living there who wasn't named can file a claim when the Sheriff posts the eviction notice, which can delay the move-out. Serve it, and those occupants have 10 days to join the case or be bound by the judgment.
Old COVID-19 rent and small claims
The Orange County court's unlawful detainer page carries a notice for landlords. As of October 1, 2025, a landlord can no longer sue in small claims for COVID-19 rental debt above $12,500. The court defines that debt as unpaid rent and other costs incurred before September 30, 2021, due to COVID-19. A San Clemente landlord with a larger claim of that kind needs a different route, such as a civil case.
Family law and probate
San Clemente divorce, custody, support and domestic violence cases are heard at the Lamoreaux Justice Center in Orange, about 28 miles north. A family law summons is usually proved on form FL-115, and a domestic violence restraining order on DV-200 after personal delivery. For any restraining order, tell us the hearing date first, then send a photo and the person's usual weekday locations. At Lamoreaux, the court's in-person self-help service runs Monday through Thursday, 8:00 a.m. to 4:00 p.m., and Friday until 3:00 p.m., with document review ending an hour before closing.
Probate and mental health cases, and elder or dependent adult abuse restraining orders, go to the Costa Mesa Justice Complex. The court's self-help page lists a live self-help kiosk at Costa Mesa, Monday through Thursday, 8:00 a.m. to 4:00 p.m., and Friday until 3:00 p.m.
Serving a San Clemente business
For a corporation, LLC or limited partnership, the Secretary of State's business search lists the agent for service of process, who accepts legal papers for the company. The Orange County small claims guide refers filers to Judicial Council form SC-104C for serving a business or public entity, and notes that a corporation with a business in California but no agent here may, in some cases, be served through the Secretary of State. Our serving corporations guide covers each option.
What to include in a San Clemente request
- The full address, and whether it's in Orange County or across the line.
- The unit, space or suite number, and any gate code or guard instructions.
- When the person is usually home, or their work schedule.
- A second location, such as a workplace.
- A photo or description, with a vehicle and plate if known.
- The court date, so service is planned against the right deadline.
- Whether the defendant lives in another county, since that stretches the small claims deadlines by 5 days.
If the address no longer works, skip tracing looks for a current one, and you approve it first. Each update comes to you by email. We make no guarantees for service. The proof of service guide explains the form that comes back.
