Morgan Hill sits in the south end of Santa Clara County, between San Jose's southern edge and Gilroy. It counted 45,483 people at the 2020 Census, and the Census Bureau estimates 45,625 for July 2025. We serve summonses, complaints, civil and criminal subpoenas, small claims, family law papers, probate notices and eviction documents in town and on the rural parcels outside it.
We run Morgan Hill requests from our Sacramento office, about 103 miles north. You send the documents and the details online, and a server makes the attempts at the Morgan Hill address.
The Diana Avenue courthouse: criminal and traffic
Morgan Hill has a courthouse inside its city limits. The South County Morgan Hill Courthouse at 301 Diana Avenue sits about 0.4 miles from the city's Census center point. Its case list on the court's site is short. Criminal and traffic, in Departments 105 through 110, and nothing else.
What the building offers, per the court's page:
- Criminal clerk: 408-695-5014, by phone Monday through Thursday 8:30 a.m. to 3:00 p.m. and Friday until noon.
- Traffic clerk: 408-556-3000 on the same schedule, plus a virtual public counter where you speak with a traffic clerk by video.
- An outside drop box with round-the-clock access, under the court's drop box guidelines.
- A children's waiting room on the first floor for children from 2 to 12 whose parents have court business there.
- A mailing address in San Jose, 191 N. 1st St., like every courthouse in the county.
None of that covers a lawsuit, a divorce or an eviction. A Morgan Hill plaintiff who drives to Diana Avenue with a civil complaint will be sent north.
Witness subpoenas for South County criminal cases
Most of the serving we do for the Diana Avenue building is subpoenas. A prosecutor or a defense attorney with a hearing in Department 105 through 110 may need a witness who lives in Morgan Hill, San Martin, Gilroy or anywhere else in the state.
Send the subpoena as issued, the department and date, the witness's home address and, if you have it, a workplace and shift. If the subpoena asks for records rather than testimony, give us the business's legal name and location so the papers reach its custodian. Our post on how to serve a subpoena in California explains the steps. When the hearing is days away, choose Rush and put the date at the top of your Letter of Instruction.
Morgan Hill civil cases travel north
Everything outside criminal and traffic goes to two buildings in downtown San Jose:
| Morgan Hill matter | Where it's filed | Straight-line miles from central Morgan Hill |
|---|---|---|
| Limited and unlimited civil | Downtown Superior Court, 191 N. First St. (Local Civil Rule 1.C) | 19.8 |
| Unlawful detainer | Downtown Superior Court (Local Civil Rule 13.C) | 19.8 |
| Small claims | Downtown Superior Court (Local Civil Rule 19.A) | 19.8 |
| Probate | Probate Clerk's Office, Room 107, Downtown Superior Court | 19.8 |
| Family law | Family Justice Center Courthouse, 201 N. First St. | 19.9 |
| Criminal and traffic | South County Morgan Hill Courthouse | 0.4 |
Distances run from the Census Bureau's internal point for Morgan Hill to the coordinates on each courthouse page. Court facts were checked in October 2026.
Attorneys e-file civil, family and probate cases, so for them the distance mostly doesn't matter. For a self-represented filer, it's a round trip of nearly 40 miles, even measured in straight lines, to clerks who close their counters at 3:00 p.m. Monday through Thursday and at noon on Friday. Our Santa Clara County court filing service can file in San Jose and then send the filed papers straight out for service in Morgan Hill.
One local form travels with every new civil complaint. Local Civil Rule 1.D has the filer give the clerk a blank Civil Lawsuit Notice, form CV-5012. The clerk returns it with the assigned judge and the first case management date, and the filer serves it with the complaint on every party. If the conference moves before service, the served copy has to show the current date. Include the completed notice in your upload, and we serve it with the summons.
One ZIP Code area, three kinds of land
Morgan Hill uses a single Census ZIP Code area, 95037, and it reaches well past the city. The 2020 relationship file splits its land like this:
- about 10% inside Morgan Hill city limits
- about 13% inside San Jose city limits
- a tiny piece, about 0.1%, in the San Martin Census-designated place
- about 77% outside any city or Census-designated place
A small slice of Morgan Hill also falls in the 95046 ZIP Code area. So a "Morgan Hill, CA 95037" envelope may belong to a house in town, a parcel inside San Jose's limits, or a ranch on unincorporated county land. All of it is Santa Clara County, so the courthouse is the same. What changes is the city government and the local ordinances that apply. Check the parcel when those things matter to the case. Census ZIP Code areas approximate postal ZIP Codes.
Papers to serve in Morgan Hill?
Rural parcels around Morgan Hill
With three-quarters of 95037 outside any city, many Morgan Hill addresses are rural, and remote areas are subject to different timelines. A rural parcel can hold more than one home, a gate at the road and a long drive. What shortens the work:
- The assessor's parcel number, if the papers or a title report give it. It pins down the property when the street number doesn't.
- Which structure. A main house, a second unit or a mobile home on the same parcel each count. Say which one the person lives in.
- Gate and animals. A locked gate, a code, a call box, loose dogs or livestock near the drive.
- The person's schedule. When they leave and when they're back. A weekday workplace in town is worth a second line.
- A map pin. Especially for addresses toward the hills on either side of the valley.
From January 1, 2027, AB 747 says a party shows reasonable diligence before substituted service by attempting personal delivery in good faith on at least three occasions, on three different days at three different times (CCP § 415.20(b)(2)). In a consumer debt case, at least one of those attempts has to be at the person's home when it's known or can be found with reasonable effort (CCP § 415.20(b)(3)). For a ranch property, three separate trips add real time. Our AB 747 guide covers the rest. We make no guarantees for service.
Serving the City of Morgan Hill
When the city is the defendant, CCP § 416.50 lets the summons be delivered to the clerk, secretary, president, presiding officer or other head of the entity's governing body. The City Clerk's office lists its address at 17575 Peak Avenue, phone 408-779-7259, Monday through Friday from 8 a.m. to 5 p.m. Its page describes the office as keeping the city's official records and supporting City Council meetings. Confirm the exact legal name and the recipient with your attorney, and send us both.
A claim for damages against a city usually comes before any lawsuit. That's a filing with the city, on its own deadline, and your attorney handles it.
Morgan Hill evictions
Every unlawful detainer in the county is filed at the Downtown Superior Court and handled by one eviction department under Local Civil Rule 13. For a Morgan Hill rental, the landlord files in San Jose, and we serve the tenants in Morgan Hill.
Send the summons, the complaint and the notice that started the case, the names of all adult occupants, and gate or unit details. A tenant who is handed the summons has 10 court days to file an answer, according to the state court self-help page. Substituted service or posting gives more time, counted from the mailing. From 2027, posting an eviction summons follows the same three-attempt diligence rule under CCP § 415.45. Our proof of service guide shows what the server's signed form contains.
Probate and guardianship papers
A Morgan Hill estate, guardianship or conservatorship is filed at the Probate Clerk's Office, Room 107 of the Downtown Superior Court. The court's probate page explains who reviews the file before a hearing. Probate examiners check each filing against the Probate Code, the Rules of Court and the local rules and write a summary for the judge. A probate staff attorney reviews urgent petitions, ex parte petitions and anything set on less than 15 days' notice, and takes appointments through (408) 882-2100. Some petitions are pre-approved without a hearing, and the court posts those results on its Advance Case Status Reports page.
For service, a probate case often means several people at several addresses: heirs, a proposed conservatee, relatives of a minor. List each one with the address and the document they get, and tell us the hearing date so the attempts are planned around it.
Small claims from Morgan Hill
Small claims for Morgan Hill are filed and heard in San Jose under Rule 19.A, and the clerk schedules every hearing there. Rule 19.C(3) adds night court sessions, scheduled as shown on the court's website, which can spare a working plaintiff a day off.
Two more rules matter after filing. Rule 19.E has a party who settles notify the court in writing at least one court day before the hearing, usually with a request for dismissal. Rule 19.G sends any small claims appeal to the Downtown Superior Court too, where a different judge hears it. The person who filed can't serve the claim personally. Our server can, and the signed proof comes back to you before the hearing.
