Tecate, California, is a small unincorporated community at the U.S. end of the Tecate port of entry, in the far south of San Diego County. It has no city government and no courthouse, and it's about 499 miles from our Sacramento office in a straight line. The city of Tecate in Mexico sits on the other side of the border. We serve the California side.
We serve summonses, family law petitions, restraining orders, eviction papers, small claims and subpoenas at Tecate addresses, and we can file the case first. Send the papers with a Service Request or by email to Service@ValproAttorneyServices.com.
Where Tecate cases are filed
San Diego Superior Court assigns every ZIP Code to one of four divisions through its ZIP Code List, form ADM-254 (Rev. 1/25). ZIP Code 91980, Tecate, is in the East County division. The list's second page then names the exceptions set by the local rules, and several of them pull Tecate cases downtown:
| Tecate case type | Where it's filed | Straight-line distance |
|---|---|---|
| Family law, domestic violence orders | East County Regional Center, 250 East Main Street, El Cajon | 24.5 miles |
| Civil harassment and elder abuse orders | East County Regional Center | 24.5 miles |
| Limited and unlimited civil, collections | Hall of Justice, 330 West Broadway, San Diego | 32.8 miles |
| Unlawful detainer | Hall of Justice | 32.8 miles |
| Small claims | Hall of Justice | 32.8 miles |
| Probate | Central Courthouse, 1100 Union Street, or North County | 32.8 miles to Central |
The local rules behind those exceptions are 1.2.2(E) for civil cases, 2.4.2(A) for unlawful detainers, 2.4.4(A) for small claims and 4.1.2(A) for probate. Distances run from Tecate's mapped point to each courthouse.
The South County courthouse in Chula Vista, about 26 miles away, isn't Tecate's division, even though it's nearly as close as El Cajon.
A border community, not a city
Tecate isn't a Census-designated place, and the Census Bureau's 2020 relationship file shows all of ZIP Code 91980's land outside any incorporated city or Census place. County government provides local services. In practice, that means:
- There's no city to sue or serve. A claim against a local public body runs to the County of San Diego or a special district.
- The mailing city isn't a city. The proof of service names Tecate as an unincorporated community in San Diego County.
- Court routing follows the ZIP Code List, not a city boundary, so 91980 alone tells you the division.
The same list includes a second Tecate ZIP Code, 91987, marked as specific to one company, TK Manufacturing, and also assigned to East County. It's not a place where people live. If a 91987 address is all you have for a person, ask for a street address before service.
The port of entry and the border
U.S. Customs and Border Protection's Border Wait Times service lists the Tecate port's operating hours as 6:00 a.m. to 10:00 p.m., with up to four passenger vehicle lanes, four pedestrian lanes and two commercial lanes. We checked it on October 29, 2026. Hours can change, so check CBP's page before planning around them.
That matters for one reason: the person you need may live on one side and work or shop on the other. We serve only on the California side. If the defendant lives in Mexico, service there follows different rules. The Hague Conference's status table lists Mexico as a party to the Hague Service Convention, in force since June 1, 2000. We don't advise on serving anyone in Mexico; your attorney decides how to handle a defendant abroad. What helps us is any California address where the person can be found: a job, a relative's home or a regular stop on this side.
Family law and protection orders in El Cajon
A Tecate divorce, custody case or domestic violence restraining order is filed at the East County Regional Center in El Cajon. The court's page lists criminal, family, civil harassment and elder or dependent adult abuse restraining orders, and juvenile dependency among the cases heard there. A public parking structure is in front of the building.
The court's family law page says the ZIP Code List governs most family cases, including divorce, custody and visitation, non-governmental child support, domestic violence orders and paternity. The exceptions go to the Central Division: surrogacy, disposition of embryos and cases involving the Department of Child Support Services.
For civil harassment and elder abuse orders, the page gives the exact spot: the Restraining Order Office on the first floor, next to Department 2. The Civil Temporary Restraining Order Clinic, next to Department 1, helps with forms on a first-come, first-served basis. Every other civil document from a Tecate case is filed at the Hall of Justice downtown.
Many East County business office phones are answered only from 8:30 to 11:30 a.m. on weekdays, the court's page says, so call early.
Restraining order hearings may be attended remotely in some cases. The court's civil restraining order hearing page says it may allow in-person or remote appearances, and that any evidence for the judge has to be received at least two court days before the hearing and served on every party named in the case. Evidence the other side never received may not be considered. For a Tecate respondent, that means the evidence packet is one more set of papers to serve, on a tight clock.
Papers to serve in Tecate?
How San Diego expects papers to be served
The court's civil proof of service page lays out the basics in plain terms. Papers that start a case, such as a summons or petition, are filed first and then served, and the court suggests serving every paper with its file stamp. Substituted service is for when personal service hasn't worked after several attempts. The papers are left with an adult who lives at the home, or with the person in charge at a business, that person is told what the papers are, and a copy is mailed first class to the same address. The person who tried to serve in person then signs a declaration of due diligence describing those efforts, filed with the proof of service.
In a domestic violence case, the same page says, the sheriff serves the papers that start the case and the order at no cost and files the proof. For other case types, the person serving must be 18 or older and not involved in the case.
Civil suits and e-filing downtown
Lawsuits with a Tecate defendant or plaintiff, from a contract claim to an injury case, are filed at the Hall of Justice. The court's e-filing page says attorneys for represented parties must e-file in all limited and unlimited civil cases under Local Rule 2.1.4. Self-represented litigants aren't required to.
That page also sets a service duty that's easy to miss. The plaintiff has to serve a copy of the court's General Order on electronic filing and form CIV-409, Electronic Filing Requirements, with the complaint or other case-initiating papers. Include both in the PDFs you send, so the Tecate defendant receives the complete set.
The page also warns that the civil division moved to a new case management system and has a significant backlog across all filing types, and it asks filers not to call about submissions pending less than a month. Build that into any deadline that depends on a conformed copy.
Tecate evictions
Unlawful detainers from every San Diego County ZIP Code, Tecate included, are filed at the Hall of Justice. The court's landlord-tenant service page lays out the steps when personal service doesn't work:
- Substituted service comes first, backed by a declaration of due diligence showing attempts at personal service under CCP § 415.20 and Local Rule 2.1.5.
- Posting is available only by court order, when the tenant can't be served in a reasonable time by personal or substituted service. The landlord submits a declaration, a proposed order and the original declaration of due diligence signed under penalty of perjury by the person who tried to serve.
- After the order is signed, the summons and complaint are posted at the property and mailed by certified mail.
The page adds a detail that fits rural properties: if the order will be posted on a garage or a boat, the declaration must say whether the defendant lives there, and if not, the mailing goes to the last known residence or business address.
Every attempt we make is recorded with its date and time, which is what a diligence declaration needs. Once the tenant is served, the response period runs: 10 court days after personal service, or 10 calendar days plus 10 court days after substituted service or posting, counted from the mailing (California Courts self-help).
Small claims for Tecate parties
All small claims in San Diego County are filed at the Hall of Justice, 330 West Broadway, Room 225, by mail or in the drop box inside on the 2nd floor, the court's small claims FAQ says. An individual can claim up to $12,500.
The court's small claims proof of service page sets the deadlines. A defendant who lives in the county must be served at least 15 days before trial, or 25 days for substituted service. For a defendant outside the county, it's 20 days, or 30 for substituted service. The proof of service has to be filed at least five days before trial, at the Small Claims Business Office, not through the exhibit upload tool.
The FAQ adds that a claim against a government agency needs a formal claim with the agency first, generally within six months of the incident. Two more points from it matter to anyone suing a hard-to-find Tecate defendant. A winning plaintiff can generally be awarded reasonable costs for an investigator to locate the other party for service. And after judgment, the winner waits 30 days from the mailing of the notice of entry of judgment before starting collection, because the other side can appeal or move to vacate in that window.
Serving at Tecate addresses
Tecate is outside any city and far from both courthouses, and remote areas are subject to different timelines. These details make the first trip count:
- A map pin or written directions, especially for a property off a private or unnamed road
- Gate codes or contact details for a locked gate
- The person's work schedule, including any job across the border
- Vehicles, a photo and anyone else living there, so the server can confirm identity
Businesses are served through their agent for service of process, found on the Secretary of State's bizfile Online. See our serving corporations page. If the person has moved, skip tracing looks for a current California address before another trip.
Filing and service together
We can file at the Hall of Justice or in El Cajon, or e-file, and then serve. Our San Diego County court filing page lists what we need, every update comes by email, and our proof of service guide explains the forms.
The ZIP Code List puts Tecate's neighbors in the same division: Potrero (91963), Campo (91906), Dulzura (91917) and Jamul (91935) are all East County, as are Boulevard (91905) and Jacumba (91934) farther east along the border. El Cajon is the division's courthouse city. For the rest of the county, see our San Diego County page.
