Santa Venetia sits just north of the Marin Civic Center, home of the county's only courthouse. The unincorporated Census-designated place counted 4,289 residents in 2020, and its center point is about 1.6 miles in a straight line from the Hall of Justice. It has no city government of its own; the County of Marin is its local government.
Being this close changes the job. Distance isn't the problem in Santa Venetia; the clock is. Ex parte hearings, same-day filings and papers that have to be served before a 10:00 a.m. cutoff all depend on timing that a nearby address can actually meet. Santa Venetia is about 69 miles from our Sacramento office, and one Service Request can cover a filing at the Civic Center and service a few minutes away.
Next door to the Hall of Justice
Marin Superior Court files every civil, family law, probate, small claims and restraining order case at the Clerk's Office in Room 113 of the Hall of Justice, 3501 Civic Center Drive, San Rafael. The court's pages give the practical schedule:
- Clerk's windows: 8:00 a.m. to noon and 1:00 to 4:00 p.m., Monday through Friday, closed over the lunch hour.
- Phones: 9:00 a.m. to noon and 1:00 to 2:00 p.m.
- New cases: arrive before 3:30 p.m., with the original and at least two copies.
- Late arrivals: the probate page says documents received after 3:30 p.m. are stamped that day but processed the next court day.
- Parking: free all day; general parking is reached from Civic Center Drive by turning onto Peter Behr Drive.
The Sheriff's civil office at 1600 Los Gamos Drive is about 2.4 miles from Santa Venetia's center point. A filing, a pickup at the clerk's office and a service attempt can realistically all happen on the same day.
Ex parte deadlines, hour by hour
Ex parte requests are where the short distance pays off. Marin's Civil Division page sets these deadlines:
| What | Deadline |
|---|---|
| Civil or family law ex parte papers to the court | 10:00 a.m., one court day before the hearing |
| Probate ex parte papers to the court | 10:00 a.m., two court days before the hearing |
| Notice to every other party | 10:00 a.m., one court business day before the appearance |
| Opposition to the court | 3:30 p.m., the court day before the hearing |
Attorneys deliver through eFiling; self-represented parties may bring papers to Room 113. The ex parte filing fee has to be paid at the Clerk's Office before the hearing. Civil ex parte matters are heard Monday through Friday at 9:00 a.m. in Courtrooms A, H and L, family law at 9:00 a.m. in Courtrooms B, E and G, and probate on Thursdays at 9:00 a.m. in Courtroom C.
The notice deadline is the one a process server can help with. When the other side has a lawyer, notice usually goes by phone or email. When it's a self-represented party who lives in Santa Venetia, a same-day hand delivery of the papers can back up a notice call. Tell us the hearing time and the 10:00 a.m. notice deadline when you send the request. General information, not legal advice.
Signed orders and the Will-Call box
Some documents can't be filed until a judge signs them. The Civil Division page names fee waivers, orders and judgments. When you submit one, include a self-addressed stamped envelope if you want copies mailed. Otherwise they go to the Will-Call box at the Clerk's Office, and someone has to pick them up.
For a Santa Venetia case, a court runner can collect a signed order from Will-Call and take it straight to service, which matters when the order sets a short deadline for serving it. E-filed documents come back differently: the acceptance email includes a link to the file-stamped copy. Under Administrative Order 26-01, each e-filed document that needs its own file stamp must be submitted as a separate PDF with its own transaction receipt, while case-opening documents may still go in as one bundle. Our Marin County court filing service handles both routes.
Court records a short drive away
Before papers go out, it often helps to confirm what's actually in the court file: the hearing date, the parties as the court lists them, or whether an earlier proof of service was filed. The Court Records Division in Room 113 is open for in-person service from 8:00 a.m. to noon and 1:00 to 4:00 p.m. Its page warns that written requests are handled in the order received and that a backlog can push some past six weeks, so for a Santa Venetia case an in-person visit is often faster.
Copies cost $0.50 a page, and files stored away from the Civic Center carry a $5 retrieval charge. The office doesn't give case information or do research by phone or email. For dates and party names, the court's ePortal offers case and calendar searches once you create an account; a calendar search can be filtered by date, case type and courtroom.
Papers to serve in Santa Venetia?
Two ZIP Codes, three communities
Santa Venetia's land, about 3.7 square miles, is split between two ZIP Code areas in the Census Bureau's 2020 ZCTA to place relationship file:
- 94903: about 2.3 square miles of Santa Venetia, roughly 62%, plus its small water area. The same ZIP holds part of San Rafael and all of the Lucas Valley-Marinwood Census community.
- 94901: about 1.4 square miles of Santa Venetia, roughly 38%. This ZIP is mostly San Rafael, with a tiny sliver of San Anselmo.
Because both ZIP Codes are shared with San Rafael, a Santa Venetia address is often written "San Rafael, CA 94903." That's fine for service. What a server needs is the house number, the unit for an apartment or condo, and anything that makes the door easy to find, such as a side entrance or a house number that's hard to see from the street.
Papers from courts outside California
Not every case touching Santa Venetia is a Marin case. A resident may be a witness in a lawsuit pending in another state, or a defendant in one.
Out-of-state subpoenas. California's Interstate and International Depositions and Discovery Act sets the route. Under CCP § 2029.300, a party submits the original or a true copy of the foreign subpoena to the clerk of the superior court in the county where the discovery will happen, together with an application on a Judicial Council form and the filing fee; no civil case cover sheet is needed. The clerk then promptly issues a California subpoena with the same terms, bearing the out-of-state caption and case number and listing all counsel. For a Santa Venetia witness, that clerk is Marin's, in Room 113. Submitting the request doesn't count as an appearance in California courts. The issued subpoena is then served on the witness like any other. Our post on how to serve a subpoena in California covers witness service.
Other out-of-state papers. The Marin Sheriff's fee schedule lists $50 to serve process from out-of-state courts, plus a $15 notary fee. A private server can serve those papers as well. General information, not legal advice.
When the County is the defendant
Because Santa Venetia has no city government, a claim about local roads, county services or county property may point at the County of Marin. CCP § 416.50 says a summons for a public entity, a category that expressly includes a county, is served by delivering the summons and complaint to the clerk, secretary, president, presiding officer or other head of its governing body.
Before most damages suits, a written claim has to be presented to the county and acted on or deemed rejected (Government Code § 945.4). The claim deadlines are short, so check them with counsel before anything else. Once a suit is filed, we can deliver the summons to the person the statute names. General information, not legal advice.
The Sheriff, two miles away
The Marin County Sheriff's Documentary Services / Civil Division serves process at Marin addresses. Its page asks for two copies of the documents per person, a completed SER-001 (or SER-001A or WG-001) listing at least one Marin address, and payment by cash or check when the papers are dropped off. Most service is $50. If it can't serve, it sends an Attempt Service Return with the dates and times of each try, and it doesn't research addresses.
For papers filed in Marin, the Sheriff files the proof of service for small claims and restraining orders itself and returns the original proof for everything else. A private server works from whatever you know, including a workplace, and can follow a person who has moved out of the county. Our guide on who can serve papers in California explains who may serve.
Papers handed over in the courtroom
Marin's Local Rule 1.51(B)(1) requires represented parties to file and serve electronically, but it excludes papers "when personal service is required by statute or rule." Rule 1.51(B)(2)(b) adds a narrow courtroom exception: during trial, and with the court's permission, a party may hand pleadings to the courtroom clerk and serve them by hand, as long as the same papers are filed and served electronically by the close of business on the next court day. The proof of service must give the date the papers were first served in open court.
The 2027 diligence rule
From January 1, 2027, under AB 747, three good-faith attempts at personal delivery, on 3 different days at 3 different times, show reasonable diligence before papers are left with another adult at the home or workplace (CCP § 415.20(b)(2)). The county clerk's register of process servers also becomes public. Our AB 747 guide explains both changes, and our proof of service guide shows what a server's proof includes.
