Mill Valley is a small city with a big ZIP Code. The 2020 Census counted 14,231 people in the city, and the Census Bureau's estimate for July 1, 2025 is 13,799. The city itself covers about 4.8 square miles of land. Its ZIP Code area, 94941, covers nearly eight times that, and most of the people in it live somewhere other than the City of Mill Valley.
That matters more for some papers than others. A summons for a person goes to wherever that person lives, whatever the jurisdiction. A lawsuit against a local government, a permit dispute or a claim tied to a road or property depends on which government is actually in charge, and in 94941 the answer is often the County of Marin rather than the city. This page sorts out the geography first, then the court rules a Mill Valley case runs into. We handle Mill Valley requests from Sacramento, about 75 miles away in a straight line.
A city of 14,000 inside a ZIP Code of 37 square miles
The Census Bureau's 2020 ZCTA to place relationship file splits ZIP Code area 94941, about 37.7 square miles of land, like this:
| Part of 94941 | Share of the land | 2020 residents of the whole place |
|---|---|---|
| City of Mill Valley | about 12.7% | 14,231 |
| Tamalpais-Homestead Valley (unincorporated) | about 12.4% | 11,492 |
| Strawberry (unincorporated) | about 3.3% | 5,447 |
| Alto (unincorporated) | about 0.3% | 732 |
| City of Larkspur | about 0.3% | (about 4% of Larkspur's land) |
| Outside any city or Census place | about 71% |
Nearly all of the City of Mill Valley's land, about 99.8%, lies in 94941. Tamalpais-Homestead Valley and Alto lie entirely inside it, and about 94% of Strawberry's land does too. Together those three unincorporated places counted 17,671 people in 2020, more than the city did. The other 71% of the ZIP Code's land isn't part of any city or Census-designated place.
Tam Valley, Homestead Valley, Strawberry and Alto
All three unincorporated places are close to the city. By the Census Bureau's internal points, Alto is about 1.3 miles from Mill Valley's center, Tamalpais-Homestead Valley about 2.0 miles and Strawberry about 2.2 miles. GNIS, the federal place-name database, also lists Tamalpais Valley and Strawberry as populated places inside those Census areas.
Because none of the three has a city government, any public entity defendant there is usually the County of Marin or a special district, not the City of Mill Valley. For papers served on an individual, the label on the address doesn't matter. "Mill Valley, CA 94941" may mean a house in the city or a house in Tam Valley, and the server goes to the house either way. What helps is the full street address, the unit or cottage designation if there is one, and a note if the home sits above or below the street on a steep lot or has a shared driveway.
When the City of Mill Valley is the defendant
A suit against the city follows different rules from a suit against a neighbor.
Before filing. For most claims for money or damages, Government Code § 945.4 bars a lawsuit against a public entity until a written claim has been presented to it and either acted on or deemed rejected. Section 911.2 sets the deadline to present that claim: six months after the cause of action accrues for death or injury to a person or personal property, and one year for most other claims. General information, not legal advice.
Serving the summons. CCP § 416.50 says a summons may be served on a public entity by delivering a copy of the summons and complaint to the clerk, secretary, president, presiding officer or other head of its governing body. The statute's definition of public entity covers cities, counties and districts. Mill Valley's City Clerk lists processing legal documents among the office's duties and works out of City Hall at 26 Corte Madera Avenue.
Timing the delivery. The city's website gives City Hall hours of Monday through Thursday, 8 a.m. to 5 p.m., closed from noon to 1 p.m. A plan built around a Friday delivery won't work. Tell us if the papers have to reach the city by a set date, so the attempt is scheduled on a day City Hall is open.
If the right defendant is the County of Marin instead, because the property or road is in an unincorporated area, the same statute applies, and the delivery goes to the clerk or another officer of the county's governing body, the Board of Supervisors. Check that before the summons issues, since the name on it decides who gets served.
What e-service doesn't replace
Marin Local Rule 1.51(B)(1) requires parties represented by attorneys to file and serve documents electronically in civil cases, including family, juvenile dependency and probate. Attorneys covered by the rule can't object to electronic service. The rule carves out one exception that keeps process servers busy: it doesn't apply when personal service is required by statute or rule.
In practice, these still need a person to hand them over:
- A summons and complaint or petition, since the defendant isn't yet a party who has agreed to anything.
- A temporary restraining order and notice of hearing, which the court says aren't enforceable until served.
- A court's order to appear for a judgment debtor examination, which must be personally served.
- A subpoena for a witness who isn't a party.
Self-represented parties aren't required to e-file or e-serve at all under Rule 1.51(B)(3), so a case with an unrepresented spouse or tenant on the other side will involve paper service throughout. General information, not legal advice.
Papers to serve in Mill Valley?
Divorce papers and the six-month clock
Marin's divorce page puts it plainly: a divorce takes at least six months, counted from the date the petitioner has the other party served with the summons and petition. The waiting period is set by state law, and the date on the proof of service is where it starts.
A few points for a Mill Valley family case:
- The petitioner can't serve the papers. Any adult who isn't a party can, and our guide on who can serve papers in California covers the rule.
- Send a recent photo and a schedule. Divorce service is personal, and a spouse who has moved out may be at a new address or a workplace in San Francisco.
- Watch for an emergency order. If the filing includes temporary orders, the notice of hearing has a service deadline of its own.
Our proof of service guide shows what the signed form records.
Deadlines at the Hall of Justice
Mill Valley has no courthouse. Every Mill Valley case goes to the Clerk's Office in Room 113 of the Hall of Justice, about 6.2 miles north of the city's center point. The Sheriff's civil office, at 1600 Los Gamos Drive, San Rafael, is about 7.7 miles away.
The court's rules set several hard times:
- New cases at the counter should arrive before 3:30 p.m. The windows are closed from noon to 1:00 p.m.
- Civil and family law ex parte papers must reach the court by 10:00 a.m. one court day before the hearing. Probate ex parte papers are due two court days ahead.
- Notice of an ex parte appearance must go to the other parties by 10:00 a.m. one court day before.
- Oppositions to an ex parte are due by 3:30 p.m. the court day before.
- E-filed documents submitted any time on a court day count as filed that day, under Local Rule 1.51(B)(6).
Our Marin County court filing service covers counter filings in Room 113 and eFiling through an approved provider.
Details that help a server in 94941
Some 94941 addresses are hard to read from the street. Send what you know:
- The exact unit, including in-law units, cottages and back houses that share a street number.
- Which side of the street the house sits on and whether the entrance is a stairway or a shared drive.
- A description and recent photo of the person, and the car they drive.
- When they're home, and a workplace if they're rarely there in daylight.
From January 1, 2027, under AB 747's changes to CCP § 415.20(b)(2), three good-faith attempts at personal delivery, on 3 different days and at 3 different times, show reasonable diligence before papers are left with someone else at the home. Our AB 747 guide has more. We make no guarantees for service.
After a judgment: levies and wage garnishments
Winning a Mill Valley case and collecting on it are separate jobs. Enforcement of a money judgment against Marin property, bank accounts or wages runs through the Marin County Sheriff's Civil Division, 1600 Los Gamos Drive, San Rafael. Its fee schedule, effective January 1, 2024, lists $45 for an earnings withholding order and $50 for a bank or third-party levy, and it needs the original writ of execution and one copy.
A few details from the Sheriff's page help with planning:
- Employers have 15 days from service of the wage garnishment packet to complete and return the Employer's Return.
- Banks and other garnishees have 10 days to return the Memorandum of Garnishee after a levy.
- A bank levy reaches only what's in the account on the day of service, so a second levy may be needed.
- A civil judgment lasts ten years and can be renewed through the court before it expires.
The Sheriff also says it can't research a debtor's address. If the debtor has left the house in 94941, a current address has to come from somewhere else first.
