Monterey sits at the south end of Monterey Bay and is home to the county's civil courthouse. The 2020 Census counted 30,218 residents, and the Census Bureau's July 1, 2025 estimate is 28,953. We take Service Requests for summonses, eviction papers, family law petitions, probate notices, subpoenas and small claims in Monterey and the towns around it.
We work from one office in Sacramento, roughly 141 miles away in a straight line, and we don't keep staff or a counter on the Peninsula. Papers arrive as PDFs on your Service Request. Reach us at 855-582-5776 or Service@ValproAttorneyServices.com.
What gets filed at the Monterey Courthouse?
Nearly every non-criminal case in the county. Local Rule 2.2 says probate, guardianship, conservatorship and all civil proceedings, including family law, harassment, child support, paternity, adoption and small claims, are commenced in the Monterey Division. Rule 6.2(B) locates the civil division at 1200 Aguajito Road and has it process and try all civil cases.
| Matter | Where it's filed | Where it's heard |

Criminal, juvenile and mental health cases go to Salinas instead, which our Salinas page covers. Court facts checked October 2026 at monterey.courts.ca.gov.
How does e-filing work for a Monterey case?
E-filing is the default. Local Rule 1.7 requires it in all case types, appellate department cases excepted, through an approved electronic filing service provider. Self-represented parties are exempt but encouraged to e-file, and a party can ask the court by ex parte application for a hardship exemption.
The rule also lists papers that don't have to be e-filed. Among them are documents with jurisdictional time limits, such as a notice of appeal or a motion to quash service for lack of personal jurisdiction, plus original wills, bonds and undertakings. Anything handed over in open court must still be e-filed by the close of business on the next court day.
E-filed papers must be text-searchable PDFs. Our Monterey County court filing service handles the e-filing or a counter filing on Aguajito Road, and how California court e-filing works explains providers and acceptance. The court has also posted proposed local rules to take effect January 1, 2027, so check the final version before relying on any rule number.
How do I get papers served in Monterey?
Upload up to 5 PDFs on a Service Request, name the party, list the addresses and pick Rush or Standard. Then use the Letter of Instruction for the Peninsula details that save an attempt.
- Use the endorsed copies. Serve the papers bearing the Aguajito Road filing stamp, or the file-stamped copy your e-filing provider returned.
- Say whether it's a home or a workplace. A hotel, restaurant or shop address works best with the person's shift times.
- Flag gates and military posts. Tell us about entry gates, guard kiosks or a federal installation.
- Give a second address off the Peninsula if the person lives in Salinas, Marina or Seaside.
- Watch your inbox. Every update comes by email.

What makes Peninsula addresses harder to serve?
Monterey covers 3 Census ZIP Code areas: 93940, 93943 and 93944. Downtown and the neighborhoods along the bay are routine. The hard cases are the gated and federal properties nearby, plus addresses that are hard to pin down.
- Pebble Beach and the Del Monte Forest. This is unincorporated county land, not part of any city. Pebble Beach Resorts says the 17-Mile Drive gates are open to the public from sunrise to sunset, so an early-morning or evening attempt at a home inside needs another plan.
- The Presidio of Monterey. The Army says access is restricted to people with proper credentials or a visit arranged in advance. An off-post address or a workplace outside the gate is the practical route.
- Carmel-by-the-Sea. The city has switched from descriptive locations to numbered street addresses, and its Street Addresses page says owners were mailed their new number. Older records may still show the old description, so send both if you have them, and see our Carmel-by-the-Sea page.
- Big Sur and the Highway 1 coast. South of Carmel, addresses are spread out along a long, winding road. Remote areas are subject to different timelines, so call before choosing Rush.
How do small claims work for a Peninsula party?
The claim is filed in Monterey and tried in Marina, about 7.5 miles north. Individuals and sole proprietors can claim up to $12,500. Corporations, partnerships, public entities and other businesses are capped at $6,250, according to the court's small claims process page.
Substituted service needs the most lead time. The court says the mailed copy must go out at least 20 days before the trial for a defendant in the county, or 25 days for one outside it, and service is complete 10 days after mailing. A defendant's claim back against the plaintiff must be served at least 5 days before the trial, and the defendant can't serve it personally.
The clerk can also send the claim by certified mail for an added fee, but service counts only when the defendant signs the receipt. If the defendant won't sign, that method fails, and personal or substituted service is the backup. Our proof of service guide explains form SC-104.
Who can serve papers in Monterey, and does a business get served differently?
Any adult who is at least 18 and isn't a party can serve most papers, and the court's small claims page says the same. Our guide to who can serve papers in California covers when a process server, the sheriff or a friend fits.
A business is served through its agent for service of process. When a hotel, inn or restaurant is run by a corporation or LLC, the person at the front desk may not be authorized to accept papers. Search bizfile Online for the agent named on the company's record, then attach it to your request. If the agent is out of the area, we serve it there. The guide to serving a corporation covers officers and court-ordered alternatives.
What does AB 747 change for Monterey service in 2027?
On January 1, 2027, the statute says how reasonable diligence before substituted service is shown: attempts on at least 3 occasions, on 3 different days at 3 different times (CCP § 415.20(b)(2)). Proofs will also need date-, time- and GPS-stamped photos (CCP § 417.10(a)(1)).
For a Pebble Beach home with daylight-only gate access, those 3 time slots take planning. Read the AB 747 guide for the full set of changes. This is general information, not legal advice.
What if the person has left Monterey?
Renters and military families can move between the filing and the first attempt. When an attempt shows the party is gone, our skip tracing service can look for a current address, and we send the papers out again once you approve it. The post on how to find a defendant in California lists what to gather first.
