Valpro Attorney Services serves summonses, complaints, subpoenas, eviction papers, family law papers and small claims in Little River, on Highway 1 along the Mendocino coast. Little River is a Census-designated place, not a town with its own government: the 2020 Census counted 94 people living inside its boundary. Van Damme State Park, which California State Parks places three miles south of the town of Mendocino on Highway 1, is close by.

Little River requests are handled from our Sacramento office, about 131 miles away in a straight line, so remote areas are subject to different timelines. Papers come in online, and each update comes to you by email.

Little River on the Census map

The Little River CDP covers about 1.7 square miles of land. Its boundary straddles two ZIP Code areas, according to the Census Bureau's 2020 ZCTA to place relationship file: about 90% of the CDP's land lies in 95456 and about 10% in 95460, the area centered on the town of Mendocino.

ZIP Code area 95456 is the one that carries the Little River name, and it's mostly outside the community:

Part of ZIP Code area 95456Share of the land
Little River CDPAbout 13%
Outside any city or Census-designated placeAbout 87%

That area covers about 11.3 square miles of land, all in Mendocino County according to the Census ZCTA to county file. ZIP Code areas only approximate postal ZIP Codes. For service, the practical reading is that a "Little River, CA 95456" address may be a house near Highway 1 or a parcel well inland on county land. Mendocino County governs all of it, so the court and the sheriff are the same either way.

Which Mendocino courthouse takes a Little River case

Mendocino Superior Court has two courthouses that accept filings:

CourthouseAddressStraight-line distance from central Little River
Ten Mile Branch700 South Franklin Street, Fort BraggAbout 11.3 miles
Mendocino County Courthouse100 North State Street, UkiahAbout 31.8 miles

Civil, probate and family law papers can be filed at either one. Juvenile, LPS conservatorship and a few specialized civil matters are filed only in Ukiah. Which judge hears a case depends on the filing party's physical address and the case type, so a coastal filing doesn't always stay on the coast. The Mendocino County court filing page explains how we file for you. Represented parties e-file most case types in Mendocino, and self-represented parties may still file on paper.

The notice that goes out with every civil summons

Mendocino's case management rule shapes the first service in a Little River civil case more than anything else. Local Rule 2.1(b) requires a local notice form with each new complaint:

  • Limited civil and unlawful detainer cases: form MCV-102, Notice of Limited Civil Case Management Conference and Order to Show Cause re: Failure to Comply.
  • Unlimited civil cases: form MCV-101, Notice of Case Management Conference and Order to Show Cause re: Failure to Comply with Service Deadlines.

The filer completes the case name. The clerk sets the hearing dates and returns the form to an e-filer, or hands it over at the counter for a paper filing. The plaintiff then serves the completed notice on every named party together with the summons, the complaint and the other initial pleadings. A cross-complainant who adds new parties serves the notice on them along with the cross-complaint.

Mendocino's proof-of-service clock

The notice exists because the same rule sets an early hearing on service. Each kind of civil case gets a joint case management conference and order to show cause about late proof of service:

Case typeHearing on proof of service set no later thanLater hearing on default or dismissal
Unlawful detainer45 days after the complaint is filed395 days after filing
Limited civil180 days after filing395 days after filing
Unlimited civil75 days after filingCase management conference at 120 days

Filing the proof of service on time vacates the order to show cause, and nobody has to appear. Miss it, and the rule allows sanctions. For a limited civil case, once an answer is filed, the court sets a status conference within 120 days of the answer.

For a Little River defendant, that means the hearing date printed on the notice is the real deadline. Put it in the Service Request, and allow for the drive from the valley when you choose Rush or Standard.

Family law papers for a coastal household

Family law runs on a parallel system under Local Rule 4.2. A new dissolution, legal separation, nullity, parentage or custody and support petition carries local form MFL-250, Notice of Family Law Case Management Conference and Order to Show Cause re: Failure to Comply with Service Deadlines.

Three points from the rule matter for service:

  1. Serve it with the petition. MFL-250 goes to the responding party with the summons and petition.
  2. 60 days. The summons, petition and notice must be served within 60 days of filing, and proof of service promptly filed.
  3. 65 to 70 days. The court sets the order to show cause about proof of service for that window after filing.

Later motions have their own rule. Under Local Rule 4.3(c), if a Request for Order wasn't served in time, the moving party files Judicial Council form FL-306 to reschedule. The court won't hear the request without a proof of timely service, unless the other party appears and waives the defect in open court. Even then, it won't proceed without a valid proof of service of the summons and petition.

Papers to serve in Little River?

Emergency family orders and notice

Requests for emergency family orders in Mendocino need proof that the other side was told. Local Rule 4.4(d) requires a notice declaration on file before the court reviews an ex parte application:

  • Domestic violence restraining order requested ex parte: local form MMC-121, Declaration re: Notice upon Ex Parte Application for Orders.
  • Temporary emergency court orders: Judicial Council form FL-303, Declaration Regarding Notice and Service of Request for Temporary Emergency (Ex Parte) Orders.

The same rule says the court disfavors emergency orders on custody, support, property use or removal from the home without a strong factual showing. Once an order is signed, it still has to be served on the other party with the papers and hearing date. Send those to us the day you get them back, and mark the request Rush.

Defaults that need more than paper

A default judgment rests on the proof of service, and some Mendocino defaults need a hearing as well. Under Local Rule 2.9, the court sets a prove-up hearing on any default request in a quiet title action, a complaint alleging fraud, or one asking for punitive damages, and it may require one in other cases. Quiet title cases over rural coastal parcels are a good example of where a clean, detailed proof of service matters later.

Small claims: certified mail and one reset

The Mendocino court's small claims page puts the limit at $12,500 for most claims, citing CCP § 116.221. Two local rules are specific to service:

  • Rule 2.13. The clerk attempts certified mail service, return receipt requested, only on a corporation, partnership or agency. The plaintiff submits local form MMC-300 with the service fee, and fee waivers don't apply to it. An individual in Little River needs personal or substituted service instead.
  • Rule 2.14. If a plaintiff can't serve the defendant before the hearing, the clerk can reset it once. The request has to be made at least three business days before the hearing. After that, continuances go in writing on the Judicial Council form.

Rule 2.14 also notes that failing to file the proof of service under CCP § 116.340(c) can lead to dismissal. Our proof of service guide explains what the return should say.

Little River evictions

An eviction from any rental in the 95456 area, from a cottage to a house, follows the same court path. Under Rule 2.1, an unlawful detainer gets its order to show cause on proof of service within 45 days of filing, so service should start right after the complaint is filed.

After personal service, the tenant has 10 court days to file an Answer, according to the Judicial Council's self-help guide. Send the MCV-102 notice, the summons and complaint, the name of each adult occupant, and which unit or cabin they live in. If a property has several buildings, a photo or site sketch helps the server pick the right door.

The sheriff's civil office is inland

The Mendocino County Sheriff's Office serves civil process from its Civil Division at 951 Low Gap Road in Ukiah. Its page lists civil business hours of 8:00 a.m. to 4:30 p.m., Monday through Thursday, and the office is closed Fridays. The page itself suggests a private process server when a person is only available at unusual hours. A private server is the other choice; our guide to who can serve papers in California explains who qualifies.

What helps on a Little River Service Request

Coastal addresses can be hard to match to a door. On the request, include:

  • The physical address, not a P.O. Box. A mailing address may not be where the person lives.
  • The side of Highway 1 the property is on, and the nearest named road.
  • Gate codes or a contact who can open a private road.
  • Which building, if the parcel has a main house and cottages.
  • A workplace, such as a job in Mendocino or Fort Bragg.

AB 747 takes effect on January 1, 2027. From then, three good-faith attempts at personal delivery on 3 different days at 3 different times show reasonable diligence for substituted service (CCP § 415.20(b)(2)). Our AB 747 guide explains the details. If a second-home owner lives elsewhere most of the year, skip tracing can find a primary address, and a company is served through its agent; see serving corporations.

How small is Little River?

Very small. The 2020 Census counted 94 residents in the Little River Census-designated place, which covers about 1.7 square miles of land. It's unincorporated, so Mendocino County is the local government. The 95456 ZIP Code area around it is larger, and most of that land is outside the CDP.

What notice has to be served with a Mendocino civil complaint?

Local Rule 2.1(b) requires a notice form with every new civil complaint: MCV-102 for limited civil and unlawful detainer cases, MCV-101 for unlimited civil. The clerk fills in the hearing dates, and the plaintiff serves the completed notice with the summons and complaint. Include it in your upload.

How soon does a Mendocino eviction need a proof of service?

Rule 2.1 sets a joint case management conference and order to show cause about late proof of service no later than 45 days after an unlawful detainer complaint is filed. Filing the proof of service on time vacates it. The tenant's answer is due 10 court days after personal service.

My family law petition hasn't been served yet. What's the deadline?

Local Rule 4.2(c) says the summons, petition and Notice of Family Law Case Management Conference (form MFL-250) must be served within 60 days of filing. The court sets an order to show cause about proof of service for 65 to 70 days after filing. File the proof of service as soon as you have it.

Will the Mendocino clerk mail a small claims case for me?

Only to some defendants. Local Rule 2.13 says the clerk attempts certified mail service on a corporation, partnership or agency, using local form MMC-300 and the service fee. For an individual in Little River, a non-party adult serves the claim, or the sheriff does.

Can Little River papers be served the same day?

Sometimes, but plan for more time. Little River is about 131 miles from our Sacramento office, and remote areas are subject to different timelines. Tell us the hearing date when you submit the request, and call 855-582-5776 if the deadline is close.

Which notice form goes with a Mendocino ex parte request?

Under Local Rule 4.4(d), a domestic violence restraining order requested ex parte needs local form MMC-121, and a request for temporary emergency orders needs Judicial Council form FL-303. Either declaration shows the other party was notified, and it's filed before the court reviews the application.
