Clearlake Oaks isn't a city. It's a census-designated place on the north shore of Clear Lake, with 2,551 residents at the 2020 Census and no city government of its own. Legal papers for someone there are served under Lake County's rules and filed with Lake Superior Court, and for most kinds of case that means the courthouse in Lakeport, about 14 miles to the west, rather than the branch in Clearlake, about 6 miles to the south.
We handle Clearlake Oaks requests from our Sacramento office, about 69 miles away in a straight line. The sections below sort out which courtroom a Clearlake Oaks matter lands in, when it's heard, and what makes a 95423 address easy or hard to serve.
Not the same place as Clearlake
The names cause mix-ups. The city of Clearlake sits at the south end of the lake, about 4.4 miles from Clearlake Oaks, and uses ZIP 95422. Clearlake Oaks uses 95423. A summons that lists the wrong one sends the server to the wrong community, and the proof of service has to show where the papers were actually handed over.
Before you send a job, compare the address on the papers with the address you actually have for the person. If they don't match, tell us which one is current. If you aren't sure where the person lives now, skip tracing can check before the first attempt.
Which courtroom hears a Clearlake Oaks matter
Lake Superior Court splits work between two buildings by case type. Straight-line distances below run from the Census center point of Clearlake Oaks to each court's map coordinates:
| Clearlake Oaks matter | Where it's heard | Distance |
|---|---|---|
| Small claims | Clearlake Branch, 7000-A South Center Drive | about 6.4 miles |
| Limited civil eviction | Clearlake Branch | about 6.4 miles |
| Child support (DCSS) | Clearlake Branch | about 6.4 miles |
| Divorce, custody, support motions | Lakeport Courthouse, 675 Lakeport Blvd. | about 14.2 miles |
| Probate and guardianship | Lakeport Courthouse | about 14.2 miles |
| Other civil suits, above or below $35,000 | Lakeport Courthouse | about 14.2 miles |
| Real property and eminent domain | Lakeport Courthouse | about 14.2 miles |
The table follows the case lists on each court's location page. Both buildings keep counter and phone hours of 8:00 a.m. to 4:00 p.m. on weekdays. Our Lake County court filing service covers either counter.
The Lakeport calendar sets your service deadline
Ordinary civil suits run on a local schedule too. Under Local Rule 8.3, the summons and complaint are to be served no later than 60 days after the complaint is filed, unless the presiding judge extends the time on an ex parte application, and the proof of service is filed within 10 days after service.
Every hearing date starts a clock for service, so it helps to know which day of the week a Lakeport matter is heard. The court's courtroom page lists these calendars, effective June 16, 2025:
- Department 1, Mondays. Civil law and motion at 9:00 a.m., civil case management conferences at 10:30 a.m. and in-person civil settlement conferences at 1:30 p.m.
- Department 1, Tuesdays. Domestic violence at 8:15 a.m., family law and motion at 10:00 a.m. and family law case management conferences at 1:15 p.m.
- Department 3, Tuesdays. Civil harassment at 8:15 a.m., probate at 10:00 a.m. and guardianships at 11:00 a.m.
- Department 4, Fridays. Adoptions and petitions to terminate a parental relationship at 9:00 a.m.
The Clearlake Branch keeps its own Monday schedule for the cases that go south. A Clearlake Oaks landlord with a limited eviction is on the 8:30 a.m. unlawful detainer calendar, held in person, and any eviction status conference or motion follows at 11:00 a.m. A Clearlake Oaks small claims trial is called at 9:00 a.m. the same morning.
A Tuesday probate hearing or a Tuesday custody motion gives you a fixed target. When you send papers, put the hearing date in the Service Request so the attempts are planned backward from it, with room for a second try if the first one misses.
Custody cases and Family Court Services
For Clearlake Oaks parents in a custody dispute, the filing is only the start. The court's Child Custody Mediation page says Family Code § 3170 requires a disputed custody or visitation case to be set for mediation before a court hearing, and that referral to Family Court Services is by court referral only. Mediation is free. Lake County is a confidential, non-recommending county, so mediators don't make recommendations to the judge.
Each parent fills out a confidential intake web form, attends an orientation class and then a mediation session. The page says orientation classes are temporarily suspended, and that a parent who lives away from the area can ask Family Court Services about another option. None of this starts until the other parent has been served with the filed papers. Personal service by an adult who isn't a party is the usual route, and our guide on who can serve papers in California explains the rules. General information, not legal advice.
Papers to serve in Clearlake Oaks?
Divorce papers and the 60-day case review
Lake runs a Family Centered Case Review Program under Local Rule 5.8. Each family law case is set for case review conferences, and the first one, about 60 days after filing, is about service. If a valid proof of service of the summons and a Family Law Status Report (form LK-100, items 1 and 2 only) are on file before that date, no one has to appear. If the petition and summons haven't been served and proved within 60 days, attendance is mandatory and the petitioner files the LK-100 anyway.
For a Clearlake Oaks spouse who files in Lakeport, that turns service into the first deadline of the case. Later conferences track the preliminary declarations of disclosure (form FL-141) and, for support requests, the income and expense declaration. Serving the respondent early keeps the first review off the calendar.
Restraining orders filed from Clearlake Oaks
Protective orders for Clearlake Oaks residents are handled in Lakeport. Domestic violence matters are on Department 1's Tuesday 8:15 a.m. calendar, and civil harassment petitions are heard in Department 3 at the same hour. Local Rule 20.2 lets a domestic violence restraining order petition be filed electronically, and the Self-Help Center offers online question-and-answer programs for both kinds of request.
A temporary order does nothing until the restrained person receives it. The petition, the order and the notice of hearing are personally served by an adult who isn't the protected person, and the server signs a proof of service for the hearing. Send a photo, a vehicle description and the hours the person is usually home or at work.
Estates and the paper-only list
A Clearlake Oaks estate, guardianship or conservatorship is heard in Lakeport. Lake allows e-filing in probate under Local Rule 20.2, but Rule 20.8 keeps a list of papers that must stay on paper, including:
- an original will or codicil
- bonds and undertakings
- subpoenaed documents
- records that are sealed, or submitted conditionally under seal
- any filing that the law requires as an original writing
So an estate case can be mostly electronic and still need one trip to the Lakeport counter for the original will. Our court filing service can make that run. Heirs and interested people who need papers in hand are served wherever they live, which may be far from the lake.
Spring Valley and the open land in 95423
ZIP 95423 is much larger than the community it's named for. The Census Bureau's 2020 ZCTA to place file puts about 122 square miles of land in the ZIP. Under 2% is in the Clearlake Oaks census area and about 4% in the Spring Valley census area. The other 94% is outside any named community.
That geography is the main service issue here. A 95423 address can be a home near the water or a parcel at the end of a long county road. Remote areas are subject to different timelines, and the outer parts of this ZIP qualify. For anything off the main road, send:
- the nearest cross road, and how far up the road the parcel sits
- a gate code, or whether a locked gate blocks the driveway
- a description of the house or a property photo
- the hours the person is usually there
Asking the Sheriff instead
The Lake County Sheriff's Civil Division, at 1431 Hoyt Ave in Lakeport, serves civil process too. Its page links the Judicial Council's SER-001, Request for Sheriff to Serve Court Papers, which became mandatory on January 1, 2024. You complete one form for each person, and add SER-001A when asking the Sheriff to enforce a writ or levy.
The page also says the office doesn't do rush service, won't discuss service status by phone and mails the proof when service is done. Fees are owed whether or not the person is served. With Valpro Attorney Services, each update comes to you by email. From January 1, 2027, three good-faith attempts on three different days, at three different times, show reasonable diligence before substituted service (CCP § 415.20(b)(2)), and the county clerk's register of process servers becomes public. Our AB 747 guide has the details.
