Benicia cases belong to the Solano County court

The Superior Court of Solano County keeps its civil, family and probate counters in downtown Fairfield, about 13.7 miles from central Benicia. Its Vallejo courthouse is closer, at about 5 miles, but the court's civil division gives the Old Solano Courthouse as its address for civil work.

All three Fairfield court buildings are downtown, and the court says the Suisun/Fairfield Amtrak station is less than a ten-minute walk from each. Everyone entering passes through metal detectors.

Across the strait is another county

Benicia's closest neighbors to the south are in Contra Costa County: Port Costa about 2.5 miles away, Crockett about 3.8, and Martinez about 5.6, reached over the I-680 bridge. Those communities use a different court. Contra Costa's where-to-file page sends all of its civil and probate cases to the Wakefield Taylor Courthouse in Martinez, and all family law cases to the Spinetta Family Law Center, also in Martinez.

So a Benicia landlord suing a tenant who moved to Martinez, or a Crockett business with a customer in Benicia, may face a choice of counties. That choice is a venue question for you or your attorney. Serving the papers is a separate step, and we serve them on either side of the water. See our Martinez page and the Contra Costa County page.

Paper filings and e-filing in Fairfield

Solano Local Rule 20 made e-filing mandatory for attorneys in civil, family and probate cases starting January 2, 2025. Self-represented parties are exempt and may keep filing in person or by mail. The e-filing page says documents are filed and served electronically except where a statute or rule requires personal service, and ex parte applications are excluded. A summons still goes into the defendant's hands.

For paper, the civil division's answers are short. Bring an original and two copies. Typed forms are preferred. The court doesn't take fax filings unless they come through a fax filing agency. Clerks can't give legal advice, but the Solano County Law Library on the third floor of the Hall of Justice is open for reference.

We file at the Fairfield counter or e-file, then return the endorsed copies and serve the papers if you want both. Our Solano County court filing page explains what we need.

Benicia evictions

A Benicia unlawful detainer is filed with the civil clerk at 580 Texas Street, or e-filed by an attorney. A few points on the court's civil pages matter to landlords:

  • The case won't show up online at first. Unlawful detainer cases are confidential for 60 days, the court says, so a new Benicia eviction isn't visible on the court's website right away.
  • There's a free advisory hotline. Landlords and tenants can call (707) 207-7330, Monday through Friday, 8:30 a.m. to 12:30 p.m. The court says the advisors come from the Better Business Bureau Serving Central California and Inland Empire Counties, and callers should have a case number or proof the property is in Solano County.
  • Jury fees come due early. In an unlawful detainer, the nonrefundable jury fee is due at least five days before the trial date.
  • The Sheriff handles the lockout. The court lists the Solano County Sheriff's Civil Division hours as 8:30 a.m. to 4:30 p.m. on weekdays, at 707-784-7020.

For first service, send the notice, the summons and complaint, and every adult occupant's name. Starting January 1, 2027, the diligence a court looks for before allowing an eviction summons to be posted is shown by attempts on at least 3 occasions, on 3 different days at 3 different times (CCP § 415.45), as our AB 747 guide explains. This is general information, not legal advice.

Papers to serve in Benicia?

Benicia family law papers

Divorce, custody, support and domestic violence cases for Benicia are filed at the Hall of Justice, 600 Union Avenue. The family law page sets a daily cutoff: ex parte applications and domestic violence restraining orders must be complete and ready to submit before 12 noon. There's no fee for a domestic violence restraining order.

The service date matters more in family law than people expect. The court reminds filers that the earliest a marriage can end is six months and one day after the respondent is served with the summons and petition. Until the respondent is served, that clock doesn't start. If the respondent lives or works in Benicia, send the filed petition, the summons and any blank response forms that go with them, and we'll serve the set.

Benicia probate and estates

Probate, trusts, conservatorships and guardianships are handled at the Hall of Justice as well. The court's probate page has three rules worth knowing:

  1. Someone else mails the notice. The petitioner must give notice of the hearing to everyone who may inherit, but another adult has to do the mailing.
  2. Original wills have a deadline. Under Probate Code § 8200, the person holding the will when someone dies has 30 days to lodge the original with the probate clerk at the Hall of Justice, and must send a copy to the executor.
  3. Pre-grants come out the day before. The court posts probate pre-grants after 2:00 p.m. on the court day before the hearing. A pre-grant becomes the court's ruling unless a party appears at the hearing, so a petitioner satisfied with it only submits an order for signature.

If a Benicia heir, beneficiary or proposed conservatee must be personally served, tell us their relationship to the case and any care-facility details.

One ZIP Code area, mostly outside the city

The Census Bureau matches one ZIP Code area, 94510, to Benicia, and about 99% of the city's land lies inside it. The ZIP Code area is much bigger than the city, though:

  • Benicia: about 44% of 94510's land.
  • Outside any city or Census-designated place: about 56%, unincorporated Solano County land.
  • Fairfield: under 1%, a thin edge.

An address that reads "Benicia, CA 94510" can therefore sit outside city limits. That doesn't change the court, because the whole ZIP Code area is in Solano County, according to the 2020 ZCTA to county file. It can change whether city or county rules apply to a property dispute, so copy the address exactly as written.

Serving a Benicia business or the city

For a corporation or LLC, look up the agent for service of process on the Secretary of State's bizfile Online and send us that name and address. The person at a Benicia counter or warehouse office usually can't accept for the company. For an unincorporated business, the Solano small claims page suggests checking the city's business licensing records or the county clerk's fictitious business name index to find the owner. Our serving corporations guide covers the other people the law allows.

Suing the City of Benicia is a public entity case. CCP § 416.50 sends the summons to the entity's clerk or other head of its governing body, and the city lists its City Clerk at City Hall, 250 East L Street.

  4. Choose Rush or Standard, and add a Fairfield filing if needed.

Benicia process server questions

Not listed here? Call 855-582-5776 during business hours, Mon–Fri 8:30 a.m.–5 p.m.

The Martinez courthouse is closer. Can a Benicia case be filed there?

Not as a Benicia case. Martinez is in Contra Costa County, and its court handles Contra Costa matters; that court files all its civil cases at the Wakefield Taylor Courthouse in Martinez, though it hears limited civil cases in Richmond. A case belonging in Solano County goes to the Solano court in Fairfield. Which county a case belongs in is a venue question for you or your attorney. We serve papers from either court.

Where is a Benicia small claims case heard?

In Courtroom 303 of the Hall of Justice, 600 Union Avenue, Fairfield, where the court lists small claims calendars Monday through Wednesday at 1:00 p.m. The claim itself goes to the clerk at the Old Solano Courthouse, 580 Texas Street. A natural person can claim up to $12,500. Source: solano.courts.ca.gov, checked October 2026.

Can I mail the notice of hearing for a Benicia probate petition myself?

Not if you are the petitioner. The Solano court's probate page says the petitioner must give notice of the hearing to anyone who may inherit, but can't be the one who mails it. Any other adult must do the mailing. Source: solano.courts.ca.gov, checked October 2026.

How is the City of Benicia served with a lawsuit?

California law delivers a summons on a public entity to its clerk, secretary, president, presiding officer or other head of its governing body (CCP § 416.50). The city's website lists the City Clerk at City Hall, 250 East L Street, Benicia, with office hours of 9:00 a.m. to 4:00 p.m. Claims and deadlines against a city follow separate rules, so check with your attorney first.

Is every Benicia 94510 address inside city limits?

No. By land, the Census Bureau's 2020 relationship file puts about 44% of the 94510 ZIP Code area in Benicia and about 56% outside any city or Census-designated place, with a small edge in Fairfield. The whole area is in Solano County, so the court is the same either way.

How does the service date affect a Benicia divorce?

It starts the waiting period. The Solano court's family law page says the earliest date marital status can end is six months and one day after the respondent was served with the summons and petition. The date on the proof of service is the date that counts, so a delay in service pushes back the earliest possible end date. Source: solano.courts.ca.gov, checked October 2026.
