Napa County, right on the Solano line

American Canyon's most important legal fact is its county. The city sits at the bottom of Napa County, and Vallejo, about 5 miles away, is in Solano County. That puts the two neighboring cities in different court systems.

The city's history page says American Canyon, once known as "Napa Junction," was incorporated on January 1, 1992. Since then it has had its own city government. City contact information lists 4381 Broadway Street, Suite 201, American Canyon, CA 94503.

For a case, that means:

  • The court is Napa County Superior Court, at its courthouses in the city of Napa, when the case is filed where an American Canyon defendant lives.
  • A claim against the city names the City of American Canyon. Ask your attorney whether a government claim has to be presented first.
  • Police matters run through a Napa County Sheriff's division, described below.

A Sheriff's division serves as city police

The city's police page says the American Canyon Police Department is a division of the Napa County Sheriff's Office. It lists 27 sworn officers and says the department also relies on investigative support from Sheriff's detectives and evidence specialists. The station is at 911 Donaldson Way East.

That structure matters when a case needs police records or an officer as a witness. A records subpoena may have to reach the Sheriff's Office as well as the city department, depending on who holds the file. Our post on serving a subpoena in California explains the basic steps, and we serve subpoenas on agencies and their custodians of records.

ZIP Code 94503 stretches past the city

The Census Bureau's 2020 relationship file gives ZIP Code area 94503 about 27 square miles of land. Only about 6.1 square miles lie inside American Canyon. Tiny pieces fall inside the cities of Napa and Vallejo, and about 20.9 square miles belong to no city or Census place.

So a 94503 address isn't automatically inside the city, and in rare cases it may not even be in Napa County, because part of the ZIP Code area touches Vallejo. When you send the address, include the street, unit and any business name exactly as your documents show them. If the property is a rural parcel outside the city, add a description or a map pin. Remote areas are subject to different timelines.

A Solano County case can also need an American Canyon defendant served. The papers come from the Solano court, but the service happens in Napa County. For small claims, the Napa court's page quotes the Napa County Sheriff's $50 rate per defendant served in Napa County and tells filers to check other counties' sheriffs for their own rules. A private server follows the same service rules on either side of the line.

Which Napa courthouse gets an American Canyon case

Napa County Superior Court takes filings at two courthouses in downtown Napa, close to each other. Straight-line distances below are from American Canyon's Census center point:

Case typeCourthouseDistance
Civil (limited and unlimited), small claims, evictions, family law, probate, juvenile filingsHistoric Courthouse, 825 Brown Street, Napaabout 8.3 miles
Criminal and trafficCriminal Courthouse, 1111 Third Street, Napaabout 8.3 miles

The court's locations page says every division is open 8:00 a.m. to 4:00 p.m., Monday through Friday, including the noon hour. Documents are accepted for filing during those hours, and a drop box for same-day filings and payments stays available until 5:00 p.m. The general information line is (707) 299-1100. The Civil Division and the Family Law Clerk's Office share (707) 299-1130, and civil research and records is (707) 299-1140.

Family law sits inside the Civil Division

The Napa court doesn't keep a separate family courthouse. Its family law filing page says the Family Law Division is part of the Civil Division, and that papers for dissolution, nullity, legal separation, child support, parentage, custody and visitation, guardianship, domestic violence and harassment are filed with the Clerk of the Superior Court. Filings are accepted from 8:00 a.m. to 4:00 p.m. on weekdays, with the drop box open until 5:00 p.m. for same-day filing. For current calendaring procedures, the page sends people to the clerk at (707) 299-1130.

Custody and visitation mediation goes through Family Court Services, reached at (707) 299-1240. Divorce and custody papers need personal service by an adult who isn't a party. Tell us about children in the home and the hearing date, and see our proof of service guide for the family law proof, form FL-115.

Papers to serve in American Canyon?

Small claims between American Canyon and Solano County

When one side of a small claims case lives in American Canyon and the other in Solano County, the Napa court's small claims page sets the timing:

  • Hearing date. A case is heard within 40 days of filing when both sides live in the same county, and within 70 days when the defendant lives outside it.
  • Service deadline. The claim must be served at least 15 days before the hearing for a defendant inside the county, or at least 20 days before for a defendant outside it.
  • Judge pro tem. Hearings are usually before a volunteer attorney serving as a temporary judge. Parties are asked to agree to that, and a party who doesn't may see the case moved to a later date.
  • Appeals. A plaintiff who loses their own claim can't appeal it. Where an appeal is allowed, the notice of appeal and fee are due within 30 days after the notice of entry of judgment is mailed.

The page lists four ways to serve the claim: certified mail by the court for $15 per defendant or address, which the defendant can refuse; the Napa County Sheriff at $50 per defendant served in Napa County; a private process server; or a neutral adult. Personal service avoids the certified-mail refusal problem. The same page describes what to expect at the hearing: no attorneys represent the parties in court, though either side can consult one before or after; typical cases involve car accidents, property damage, landlord and tenant disputes and personal debts; and each party should bring evidence such as photos, receipts or contracts, plus a copy for the other side. The judge may rule at the hearing or mail the decision later. For who can serve, see who can serve papers in California.

Probate and guardianship for American Canyon families

Estates and trusts from American Canyon are handled by the same Civil Division at the Historic Courthouse. The court's civil page describes probate as the process of validating a will, supervising the estate's administration and distributing assets, and gives the Civil Division's number, (707) 299-1130, for probate questions. It also links the statewide registry of private conservators, guardians and trustees and a bond calculator for conservatorships and guardianships. Guardianship papers are filed with the clerk alongside family law filings.

Probate and guardianship petitions often require notice or personal service on relatives by a set date before the hearing. Send us the hearing date with the papers so the attempts land in time.

Copies and records from Napa case files

Basic case information is on the court's online portal. For anything else, the research and records page describes the process:

  1. Use the right form. The Civil, Family, and Probate Records Request Form goes by mail or in person to 825 Brown Street, first floor.
  2. One name per form. Each alias needs its own request.
  3. Daily limits. Searches are capped at 10 names or 10 case records a day.
  4. Card details. Each form needs a Visa or Mastercard number and expiration date.
  5. Fees. A search that takes more than 10 minutes costs $15. Copies are $0.50 a page, and certified copies $40.

The page adds that only authorized people can get calendar or case information by phone. Our document retrieval service handles record requests for you.

E-filing, mediation and remote hearings

The Napa court accepts electronic filing in civil, family, probate and other case types through approved providers, and no local rule makes it mandatory. The eFile page puts one duty squarely on the filer: social security numbers, driver's license numbers and other sensitive data must be redacted before filing, because the court can't redact electronically filed documents.

The court and the Napa County Bar Association also run a voluntary mediation program for civil, probate, trust, estate, guardianship, conservatorship and family law disputes, when all parties agree. Custody and visitation issues go to Family Court Services instead. Panel mediators provide the first three hours of three mediations a year free of charge. The parties file a Stipulation Re: Voluntary Mediation with the program coordinator, and the mediation has to be finished within 60 days of the referral. It doesn't extend discovery, motion or trial dates.

For remote hearings, the court's page says remote appearances are at the judge's discretion and asks people with questions about a remote hearing to call (707) 299-1100 rather than email.

Evictions in American Canyon

A landlord renting property in American Canyon files the unlawful detainer at the Historic Courthouse in Napa. After the summons is served, the tenant has 10 court days to answer after personal delivery, not counting weekends and court holidays. When the papers are left with another adult or posted and then mailed, the time is 10 calendar days plus 10 court days from the day after the mailing. Posting requires a court order under CCP § 415.45. The Napa court's civil page notes that unlawful detainer suits have priority over most other cases and are set for trial promptly, so a landlord should be ready to prove service soon after the answer period ends.

Do American Canyon cases go to the Vallejo courthouse?

No. Vallejo is in Solano County, and American Canyon is in Napa County. A case against an American Canyon resident is normally filed with Napa County Superior Court. Civil, small claims, eviction, family law and probate papers go to the Historic Courthouse at 825 Brown Street, Napa, about 8.3 miles from American Canyon's Census center point.

Who handles police work in American Canyon?

The American Canyon Police Department, which the city describes as a division of the Napa County Sheriff's Office. The city's police page lists 27 sworn officers, investigative support from Sheriff's detectives and evidence specialists, and a station at 911 Donaldson Way East. A subpoena for an officer's records or testimony should account for that arrangement.

How soon will an American Canyon small claims case be heard?

The Napa court's small claims page says a case is heard within 40 days of filing when both sides live in the same county, and within 70 days when the defendant lives outside it. A defendant across the line in Vallejo or elsewhere in Solano County puts the case on the longer schedule and calls for service at least 20 days before the hearing.

Can the Napa clerk mail the claim instead of using a process server?

Yes, for $15 per defendant or address, by certified mail. The court's page warns that the defendant doesn't have to accept certified mail. The Napa County Sheriff charges $50 for each defendant served in Napa County. A private process server or a neutral adult who isn't a party are the other options listed.

How do I order copies from an American Canyon case file?

Use the court's Civil, Family, and Probate Records Request Form, by mail or in person at 825 Brown Street, first floor. Each form covers one name, a Visa or Mastercard number is required, and searches are limited to 10 names or 10 case records a day. Copies are $0.50 a page and certified copies $40.

California Courts says 10 court days after personal service, not counting weekends and court holidays. After substituted service or posting, the tenant has 10 calendar days plus 10 court days, counted from the day after the mailing. The method on the proof of service sets the count.

Is there a courthouse in American Canyon?

No. Napa County Superior Court's filing courthouses are both in downtown Napa: the Historic Courthouse at 825 Brown Street for civil, family, probate, small claims and eviction filings, and the Criminal Courthouse at 1111 Third Street for criminal and traffic. Juvenile hearings are held at a third site on Old Sonoma Road, which doesn't accept mail.
