Ocean Street or Second Street?

The court splits case types by building, not by where the parties live.

Santa Cruz Courthouse, 701 Ocean Street, Santa Cruz. The Civil Division here processes all civil matters, including general civil, name changes, probate and unlawful detainer. Criminal cases are filed only here. The clerk's office is open 8 a.m. to 3 p.m. on weekdays, and a mail slot takes paper filings after 3 p.m. The county law library is in the basement, Room 70.

Watsonville Courthouse, 1 Second Street, Watsonville. Family law, child support, small claims, juvenile cases and all restraining requests go here, to the clerk's office in Room 300. The Self-Help Center is next door in Room 301. Clerk hours match Santa Cruz, 8 a.m. to 3 p.m.

So an eviction from a Watsonville rental is filed in Santa Cruz, while a small claims case from downtown Santa Cruz is filed in Watsonville.

Restraining requests: Watsonville, by 10 a.m.

Every restraining request in the county is filed and heard in Watsonville. That covers domestic violence, elder abuse, civil harassment, workplace violence, gun violence and postsecondary school violence. The court's page says a request has to reach the clerk by 10 a.m. to be considered that day. Changes, terminations and any later filings in the same case also go to Watsonville.

Once the court rules on a temporary request and sets a hearing, the other side has to be served before that hearing. Send us the full packet with the hearing date and we serve it, then return the proof of service. Family law ex parte practice has its own deadlines, covered on our Watsonville page.

Small claims on Thursday afternoons

All small claims cases are filed and heard in Watsonville, with hearings on Thursdays at 1 p.m. and 1:30 p.m. Parties can appear in person or by Zoom after filing form RA-010. A remote party still has to submit evidence to the court and serve it on the other side before the hearing.

New claims can be prepared online through Odyssey Guide & File and then e-filed, filed at the counter or mailed. Later documents in the case have to go through an e-filing service provider instead. Once the claim is accepted, the court emails a file-stamped copy, which is what gets served. The claim limit is $12,500.

E-filing for attorneys

Santa Cruz offers e-filing in every case type, and attorneys are required to use it. Local Rule 1.3 lists the documents exempt from the mandate. Self-represented litigants can e-file but don't have to. E-filings can be submitted 24 hours a day under Code of Civil Procedure section 1010.6. General information, not legal advice.

We handle paper and electronic filings through Santa Cruz County court filing. Our post on California court e-filing explains how filing service providers work.

Mountains, beach towns and farmland

Santa Cruz County had 270,861 residents in the 2020 Census. Only four of its communities are incorporated: Santa Cruz (62,956), Watsonville (52,590), Scotts Valley (12,224) and Capitola (9,938). From our Sacramento office they sit about 111 to 118 miles away straight-line.

Many residents live in unincorporated communities such as Live Oak, Soquel, Aptos, La Selva Beach, Felton, Ben Lomond and Boulder Creek. These addresses work the same as city addresses for service. Use the street and ZIP the person uses.

The terrain is what slows things down:

  • Santa Cruz Mountains and the San Lorenzo Valley: winding roads off Highway 9 and Highway 17, private drives and homes set well back from the road.
  • North coast: Davenport and the ranch and farm land along Highway 1 toward San Mateo County.
  • Pajaro Valley: farm parcels and rural roads around Watsonville, Corralitos and Freedom.

Remote areas are subject to different timelines. Gate codes, driveway descriptions and vehicle details save the most time in the mountains.

Santa Cruz County process server questions

Not listed here? Call 855-582-5776 during business hours, Mon–Fri 8:30 a.m.–5 p.m.

Which Santa Cruz County courthouse takes my filing?

It depends on the case type. The Santa Cruz Courthouse at 701 Ocean Street takes civil, probate, unlawful detainer and name change filings. The Watsonville Courthouse at 1 Second Street takes family law, small claims, juvenile and every kind of restraining request. Both clerk's offices are open 8 a.m. to 3 p.m. on weekdays. Checked October 29, 2026.

Can I file after 3 p.m.?

On paper, yes, by the mail slot at the Santa Cruz Courthouse or the after-hours box in Watsonville; the court's division pages describe both. E-filing is open 24 hours under Code of Civil Procedure section 1010.6. Attorneys must e-file, so the after-hours slot is mainly for self-represented filers. General information, not legal advice.

What's the cutoff for a same-day restraining request?

The court's restraining orders page says requests must reach the Watsonville clerk's office by 10 a.m. to be considered the same day. Every type, including civil harassment, workplace violence and elder abuse, is filed and heard in Watsonville, Room 300. A request brought to Room 110 in Santa Cruz is scanned over to Watsonville.

When are Santa Cruz County small claims hearings?

Thursdays at 1 p.m. and 1:30 p.m. at the Watsonville Courthouse, in person or by Zoom with form RA-010 filed in advance. All small claims cases in the county are filed and heard in Watsonville. The claim limit is $12,500. Checked on the court's small claims page October 29, 2026.

Can you serve papers in Boulder Creek, Bonny Doon or the Summit area?

Yes. Those mountain areas are part of our Santa Cruz County coverage. Remote areas are subject to different timelines. Add the driveway or gate description, a landmark and the best time to catch the person.

Is e-filing required in Santa Cruz Superior Court?

For attorneys, yes. The court's e-filing page says e-filing is available for every case type and mandatory for attorneys, with exceptions listed in Local Rule 1.3. Self-represented litigants are encouraged to e-file but may file by mail or at the counter. Domestic violence restraining requests can be e-filed at no cost using a waiver account.
