Atwater is Merced County's third-largest city, with 31,970 people at the 2020 Census and an estimated 32,133 in mid-2025. It sits on the valley floor northwest of Merced, and it has no courthouse of its own. The Merced County Superior Court splits the county into two districts, and Atwater's cases go to the courthouses in the city of Merced, a short drive away.
There are two Merced buildings an Atwater filer needs to know: the Old Merced Courthouse on West 21st Street for civil, eviction, probate and small claims cases, and the Ogletree Jr. Courthouse on N Street for family law. The Old Merced Courthouse is about 7 miles from Atwater's Census center point in a straight line. Atwater is roughly 100 miles from our Sacramento office, close enough that we plan filing and service together as one job.
Why Atwater files in Merced, not Los Banos
Local Rule 1 of the Merced court divides the county into two districts. The West County District is the Los Banos courthouse, and the rule defines it by ZIP Code: 95322 for Gustine and Santa Nella, 95374 for Stevinson, 93620 for Dos Palos, 93635 for Los Banos and 93665 for South Dos Palos. Everything else in the county is the Merced District, served by the courthouses in Merced.
Atwater's ZIP Code, 95301, isn't on the West County list, so an Atwater case belongs in the Merced District. The rule adds that a case is generally heard in the district where it arose, where disputed land sits, or where a party lives, and that the court can transfer a case filed in the wrong district. If both sides live in Atwater, Merced is the place.
Two Merced buildings for Atwater cases
| Atwater matter | Merced courthouse |
|---|---|
| Unlawful detainer (eviction) | Old Merced Courthouse, 627 W 21st Street, Civil Division |
| Limited civil, $35,000 or less | Old Merced Courthouse; law and motion in Courtroom 9 |
| Unlimited civil, over $35,000 | Old Merced Courthouse; matters heard in Courtroom 8 |
| Small claims, including night court | Old Merced Courthouse |
| Probate, guardianship, conservatorship | Old Merced Courthouse |
| Divorce, custody, support | Ogletree Jr. Courthouse, 2260 N Street, second floor |
| Criminal | Ogletree Jr. Courthouse, first floor |
The court's Civil Division page lists the law and motion schedule. Limited civil matters are heard Mondays at 1:30 p.m. and Wednesdays and Thursdays at 10:00 a.m. in Courtroom 9. Unlimited civil matters are heard Monday through Friday at 8:15 a.m. in Courtroom 8, unless the court says otherwise.
Counter hours, drop boxes and how to pay
The Civil Division clerk at the Old Merced Courthouse, (209) 725-4111, takes filings in person and answers the phone from 8:00 a.m. to 3:00 p.m., Monday through Friday. The Family Law Clerks' Office at the Ogletree Jr. Courthouse keeps the same hours, at (209) 725-4117.
Each building has a drop box. At the Old Merced Courthouse it's by the set of double doors on the southwest corner of the building. At the Ogletree Jr. Courthouse it's outside the front doors on N Street.
Payment rules trip people up here. The Civil Division page says the court accepts cash and money orders over the counter; personal checks need a financial declaration. By mail, the court takes money orders and personal checks up to $25. It doesn't accept credit or debit cards at this time. To get conformed copies back, include a self-addressed stamped envelope with the filing.
E-filing is required for represented parties
Merced's Local Rule 2 says parties must file electronically in limited, unlimited and complex civil actions and in family law and probate matters other than child support agency cases, unless the court excuses them. Self-represented parties are exempt from mandatory electronic filing and service. Criminal subsequent filings may be e-filed, and so may domestic violence and gun violence restraining order petitions.
The court's e-filing page points to Odyssey eFileCA, run by Tyler Technologies, and notes a $1.00 minimum credit card convenience fee on e-file transactions since September 1, 2024. Our Merced County court filing page explains how we file for you and then serve the filed papers. General information, not legal advice.
Atwater evictions
An Atwater landlord files the unlawful detainer with the Civil Division at the Old Merced Courthouse. The Civil Division page links the court's own Unlawful Detainer Instructions document, which is worth reading before filing. After filing, the summons and complaint must be served on each tenant named. A tenant who is personally served has 10 court days to answer.
For a smooth first attempt, give us:
- the unit number, or the space number in a mobile home park
- every adult occupant the papers name
- whether there's a gate, a back unit or a shared driveway
- the hours someone is usually home
If the tenant has already moved out and you need them served elsewhere, skip tracing can look for a new address. Our post on how to find a defendant in California explains what records can turn up.

Small claims for Atwater residents
Atwater small claims cases are filed with the Civil Division at the Old Merced Courthouse. The Merced court offers more small claims help than many counties:
- Night court. Hearings on the second Wednesday of each month at 5:00 p.m., at the Old Merced Courthouse. You must ask for night court when you file, and spots go first come, first served. Interpreters aren't available at night court.
- Small claims advisor. A free advisor answers calls at (209) 725-4168 from 8:00 a.m. to noon, and takes email questions at smallclaims.advisor@mercedcourt.org. The court lists advisor locations at the Ogletree Jr. Courthouse and the Los Banos courthouse.
- Settlement office. The court lists a small claims settlement office at the Old Merced Courthouse, open Mondays and Tuesdays from 9:30 to 11:30 a.m.
The court's small claims page also lists common filing deadlines, which it calls statutes of limitations: generally 2 years for an injury, 2 years for a broken spoken agreement, 4 years for a broken written one, and 3 years for property damage or for fraud, counted from when the fraud was discovered. A claim against a government agency usually starts with a claim to the agency itself within 6 months. Ask the advisor if your dates are close. General information, not legal advice.
Once the claim is filed, the defendant has to be served by someone other than the plaintiff. A defendant living in Merced County must be served at least 15 days before the hearing, and one living in another county at least 20 days before (CCP § 116.340). The server then completes form SC-104.
Family law papers from Atwater
An Atwater divorce, legal separation, custody or support case is filed at the Ogletree Jr. Courthouse, 2260 N Street. Family Court Services is on the second floor of the same building, and the court says child custody recommending counseling sessions are currently done by phone or video on a date the court sets.
After filing, the petition and summons must be served on the other party. If you have the person's work schedule, workplace or a second address, include it. The court's Self-Help Center is on the first floor, but it's closed to walk-ins; it answers calls at (209) 725-4168 from 8:00 a.m. to noon.
Restraining orders for Atwater residents
Where a restraining order is filed depends on the relationship. A domestic violence petition, between spouses, partners, family members or people who dated, is a family law matter at the Ogletree Jr. Courthouse; Local Rule 2 also lets it be filed electronically, as it does a gun violence restraining order petition. A civil harassment petition, against a neighbor, a coworker or someone else outside the family, is a civil case handled by the Civil Division at the Old Merced Courthouse.
Either way, the restrained person must be handed the temporary order and the notice of hearing by someone other than the person protected, before the hearing. Send a recent photo, a description of the person's car, and where they work or spend time, along with the hearing date, so the server can plan attempts that fit the deadline.
95301 beyond the city limits
Atwater has one ZIP Code area, 95301. The Census Bureau's 2020 relationship file measures about 197 square kilometers of land in it. About 8.6% is inside Atwater city limits and about 7.0% is McSwain, an unincorporated Census-designated place. The other 84% lies outside any city or Census place.
So an "Atwater, CA 95301" address can be a house on a city street, a home in McSwain, or a rural parcel with the house set well back from the road. For anything outside town, send cross roads or a map pin, describe the gate and driveway, and mention dogs. Remote areas are subject to different timelines, though most of 95301 is a short drive from town.
Serving an Atwater business
For a corporation or LLC, look up the agent for service of process on the Secretary of State's bizfile Online and send us the name and address exactly as listed. A small Atwater business may list its owner at a local address; a larger company may name a commercial registered agent in another county. Our serving corporations page explains the rules for each.
2027 changes to substituted service
From January 1, 2027, AB 747 provides that three good-faith attempts at personal delivery, on 3 different days at 3 different times, show reasonable diligence before papers are left with another adult at the home (CCP § 415.20(b)(2)). County clerks' registers of process servers also become public (Bus. & Prof. Code § 22355). Our AB 747 guide explains the details, who can serve papers in California covers who may serve, and the proof of service guide shows what you receive. We make no guarantees for service. General information, not legal advice.
