Winters is an incorporated city in the southwest corner of Yolo County, about 26 miles from our Sacramento office. We serve summonses, subpoenas and every other legal document at Winters homes, farms and businesses, and we can file the case in Woodland on the same request.

One courthouse in Woodland

Yolo County runs a single courthouse. Local Rule 2.1 says only that the court is in the City of Woodland, and the court's location page lists 1000 Main Street for civil, probate, juvenile, small claims and family matters, plus criminal and traffic. A Winters case never goes to a branch, because there isn't one.

The phone and window hours are 8:00 a.m. to 4:00 p.m. on weekdays. The line for civil, probate, juvenile, small claims and family is (530) 406-6704. The court's free public and ADA parking is in the lots on Sixth Street, with loading zones in front of the courthouse on Main Street and 20-minute parking on Fifth and Sixth Streets.

Our Yolo County court filing service handles the e-filing or the counter for Winters cases. The Yolo County hub covers the rest of the county.

The service packet for a Yolo civil case

Yolo adds documents to the usual summons and complaint. Under Local Rule 12.2, the clerk sets a case management conference when the complaint is filed, roughly 120 days out. For a limited collection case it's set 385 days after filing. Then Rule 12.2(d) requires the plaintiff to serve each defendant with three more items:

  1. the Notice of Case Management Conference,
  2. the court's Alternative Dispute Resolution information packet, and
  3. any local forms the clerk hands out with the filing.

The rule makes these part of service, not an optional extra. When you send a Winters defendant's papers to us, upload the whole packet, and we list each document on the proof of service.

The clock runs from the filing date. Rule 3.110 of the California Rules of Court says the complaint must be served on all named defendants, and the proofs filed, within 60 days after the complaint is filed. If a defendant is added by amendment, it's 30 days. A party who needs more time has to apply before the deadline passes, with a declaration describing the service efforts so far.

Winters addresses in Solano County

The 95694 ZIP Code area crosses the county line. The Census Bureau's 2020 relationship file gives it about 133 square miles of land: about 107 in Yolo County and about 27 in Solano County. The City of Winters accounts for under 3 square miles.

A 95694 mailing address can therefore sit in Solano County, on the far side of the line from the city. When it does:

  • The Yolo County Sheriff won't serve it. Its civil page requires a valid physical address within Yolo County.
  • The Solano County Sheriff, based in Fairfield, would be the sheriff for that address.
  • The case itself doesn't move. A Yolo case stays in Woodland even if the defendant lives just across the county line. Whether a new case belongs in Yolo or Solano is a venue question for you or your attorney.

A private server isn't limited by county. Any adult who isn't a party may serve papers anywhere in California, so we take Winters addresses on both sides of the line. See who can serve papers in California for the rule, and the Solano County hub if the case is filed there.

Filing a Winters case electronically

Yolo has required e-filing since August 17, 2020, in civil, family and probate cases, and in later filings in criminal, juvenile and child support cases. Self-represented parties are exempt but are encouraged to use the court's File @ Home and eFile tools. Filers pick an electronic filing service provider, and a single registration works with any provider.

The civil division's filing guidelines add Local Rule 7 on e-service: in civil, probate and family cases, documents are filed and served electronically except where personal service is required by statute or rule, and except ex parte applications. A summons is the clearest example of a paper that still has to be served by hand. If a filing arrives without the correct fee, the court returns it unfiled.

Timing follows Local Rule 7.5. A document e-filed before midnight on a court day is filed that day. Anything received between 11:59 p.m. and 7:59 a.m., or on a weekend or court holiday, takes the next court day's date. Under Rule 7.6, a party with a fee waiver doesn't pay e-filing or e-service fees, and a party without one can ask for a waiver on forms FW-001 and FW-002.

For more on electronic filing, see our post on California court e-filing.

Video hearings under Local Rule 2.4

Yolo's remote-hearing rule is broad. Local Rule 2.4 authorizes remote appearance in all civil proceedings, including domestic violence and gun violence restraining order petitions, subject to the judge's power to require someone in court. For a non-evidentiary hearing, a party can simply say at the start that they'll appear remotely, and that notice can cover the rest of the case.

The bigger difference is for evidence. Evidentiary hearings and bench trials are held remotely unless the court orders otherwise. A party who objects follows Rule 3.672(h)(3)(A) of the California Rules of Court.

For a Winters party, that can mean a deposition subpoena or a trial subpoena served in Winters for testimony given from home. The subpoena still has to be served properly. Our post on serving a subpoena in California explains what changes by subpoena type.

Papers to serve in Winters?

Small claims for Winters residents

An individual can file a small claim in Yolo for up to $12,500. No one may file more than two small claims for over $2,500 each in a calendar year. You can consult a lawyer beforehand, but lawyers can't appear for you in court.

The small claims advisor takes calls at 530-207-4233, for small claims cases only. The court's Self-Help Center, on the second floor at 1000 Main Street, also helps with small claims and unlawful detainers, along with family law, guardianships and restraining orders. Its walk-in hours are Tuesdays and Thursdays from 8:30 a.m. to 2:30 p.m., with a check-in kiosk to the right of the entrance. Live chat runs Mondays, Wednesdays and Fridays.

The claim has to be served by the deadline set by the hearing date. California's self-help guide gives 15 days before the hearing for a defendant in the same county, or 20 days for one in another county. A Winters plaintiff suing someone on the Solano side of 95694 in Yolo should count 20.

Winters evictions and the sheriff lockout

An unlawful detainer for a Winters rental is filed in Woodland. The court's eviction self-help page sends landlords and tenants to Legal Services of Northern California and Law Help Interactive for forms.

The tenant's answer period depends on how the summons was delivered. Personal delivery allows 10 court days. Substituted service or posting, followed by mailing, allows 10 calendar days from the mailing plus 10 court days. For background on 2027 changes, see the AB 747 guide.

The Yolo County Sheriff's civil page sets its own requirements for eviction papers. Service of a summons and unlawful detainer complaint costs $50 per named party. Serving a Prejudgment Claim of Right to Possession on unnamed occupants is $50 and needs six copies of the summons, complaint and a blank claim form. After judgment, a lockout takes an SER-001, an SER-001A describing the property, and the original writ of possession with three copies. The sheriff posts a Notice to Vacate before the lockout.

Family law and probate papers

Divorce, custody, support and domestic violence cases from Winters are heard in the Family Law Department at 1000 Main Street. The court's family law FAQ makes a point that trips up many self-represented parties: proof of service is required, and the papers must be served by someone over 18 who isn't a party to the case. The Family Law Facilitator can help with the forms.

When the county's child support agency is involved, the paperwork still gets filed with the court, in person, by mail or by e-filing. Questions about arrears go to Yolo County Child Support Services at (530) 661-2880, not the clerk.

Probate petitions for Winters estates are filed in Woodland as well. The court posts a probate note calendar online. Its notes are a recommendation on each petition, and unlike tentative rulings they don't automatically become the court's order. A note that flags missing notice to an heir is a cue to serve or mail that notice again.

For a trial or long hearing, plan the record early. Local Rule 6.1 says official court reporters normally aren't available in civil, family or probate matters, and Rule 6.2 requires a written request at least 5 court days before the date for any reporter the court can supply. Otherwise a party may arrange a certified shorthand reporter at its own cost.

Restraining orders in Winters

The Yolo County Sheriff serves many restraining orders for free, either under a court fee waiver or when the law requires free service, such as in domestic violence cases. Otherwise the fee is $50 per party. The requester brings an SER-001 and two complete sets of the court-issued papers. When service is completed, the sheriff files the proof of service with the court. A private server can also serve these papers when timing matters.

Sheriff or private server

The Sheriff's Civil Division serves Yolo papers at its public counter hours, 8:30 a.m. to 4:30 p.m. on weekdays. Its page lists the limits plainly. Documents must reach the office at least 10 days before the last day for service. It can't use stakeouts or database searches to find someone. It needs a valid Yolo address. If service fails, it sends a declaration of diligence.

We work differently. You send the papers on a Service Request, add what you know about the person in the Letter of Instruction, and choose Rush or Standard. Each update comes to you by email. When service is done, we return a signed proof of service; the proof of service guide shows which form applies. We make no guarantees for service.

Copies of a Yolo file

Most civil files are public. The civil division takes requests at the civil filing counter, by mail or through a private agency. A mailed request needs the case number if known, the party names, the document wanted and a self-addressed stamped envelope. The court suggests a check marked "not to exceed" a set amount.

For a pending civil case other than small claims or unlawful detainer, staff will answer status questions by phone at (530) 406-6704. They can't give legal advice. To have someone pull the file for you, see document retrieval.

Which courthouse handles a Winters lawsuit?

Yolo Superior Court at 1000 Main Street, Woodland. The court's Local Rule 2.1 places the court in the City of Woodland, and the court lists no other building, so civil, small claims, unlawful detainer, family law and probate cases from Winters all go there. It's about 15 miles from the center of Winters in a straight line.

What has to be served along with a Yolo civil complaint?

More than the summons and complaint. Yolo's Local Rule 12.2(d) has the plaintiff serve each defendant with the Notice of Case Management Conference, the court's ADR information packet and any local forms the clerk provides. Send all of them on your Service Request so the proof of service lists every document.

Will the Yolo County Sheriff serve an address on the Solano side of 95694?

No. The Sheriff's civil page says the requester must give a valid physical address within Yolo County. About 27 of the 133 square miles in the 95694 area are in Solano County, where the Solano County Sheriff serves. A private server can serve on either side of the county line.

Can a Winters witness testify by video in a Yolo case?

Usually yes. Under Yolo's Local Rule 2.4, evidentiary hearings and bench trials are held remotely unless the court orders otherwise, and remote appearance is allowed in all civil proceedings, subject to a judge requiring someone in person. Anyone opposing a remote evidentiary hearing follows Rule 3.672(h) of the California Rules of Court.

How much time does a Winters tenant have to answer an eviction?

Ten court days after the papers are handed over, not counting weekends or court holidays. After substituted service or posting plus mailing, it's 10 calendar days from the mailing and then 10 court days. Service through Safe at Home allows 15 court days. This is general information, not legal advice.

Who can help a Winters resident with a small claims case?

Yolo's small claims advisor takes calls at 530-207-4233, for small claims cases only. The Self-Help Center on the courthouse's second floor also helps with small claims and evictions. Walk-in hours are Tuesdays and Thursdays, 8:30 a.m. to 2:30 p.m., and phone help is on Mondays, Wednesdays and Fridays.
